Résumé
La Charte africaine des droits de l’homme et des peuples se distingue des autres instruments internationaux. Elle proclame non seulement des droits, mais également des devoirs, tant sur le plan individuel que collectif. Le contrôle de cette Charte est confié à une Commission africaine des droits de l’homme et des peuples, qui est l’organe principal de la Charte. Cependant, vingt ans après son adoption, la Charte africaine ne permet pas encore une mise en oeuvre effective des droits de l’Homme sur le continent africain.
L’OUA a adopté un projet de protocole à la Charte africaine dont le but est de créer une véritable Cour. Néanmoins, cette méthode comporte des lacunes institutionnelles en ce qui concerne le mécanisme des garanties procédurales. Les auteurs relèvent non seulement les insuffisances de la Commission, mais également les lacunes sur le statut de la Cour. Ils dégagent les possibilités de ce nouveau mécanisme tout en déterminant les limites intrinsèques et opérationnelles qui peuvent occasionner une entrave à l’efficience du mécanisme de protection.
Abstract
The African Charter on human and peoples’ rights is distinguishable from other international instruments. It asserts not only the rights, but also the duties, on both the individual and society. Its control is conferred on the principle organ of the Charter, an African human rights commission. Nevertheless, twenty years after its adoption, the African Charter does not yet permit a practical application of human rights on the African continent.
The OUA is currently has adopted a draft protocol, the goal of which is to create a court for the application of the African Charter. Nevertheless, this method has serious institutional problems with respect to the mechanism for procedural guaranties. The authors consider not only the Commission’s flaws in this respect, but also the deficiencies of the Court’s statute. The authors analyse the potential of this new mechanism while addressing the intrinsic and operational limits the totality of which could become a serious obstacle to the protective mechanism’s efficiency.
