S’il était auparavant uniquement un « co-producteur » du droit international (pénal), le rôle du Conseil de sécurité a évolué ces dernières décennies. La question de savoir si le Conseil de sécurité exerce des fonctions de procureur, de juge et/ou de législateur doit dès lors être mise en exergue. En effet, d’une part, le Statut de la Cour pénale internationale attribue au Conseil le pouvoir de déférer une situation au Procureur aux fins d’enquête ; il peut aussi arrêter une enquête ou des poursuites pour une période de 12 mois renouvelable. Cela donne à penser que nous pouvons aujourd’hui parler d’un « Conseil de sécurité-Procureur ». D’autre part, la « lutte contre le terrorisme » est symptomatique de l’évolution vers un Conseil de sécurité juge et législateur. Dans ce contexte, il s’est, notamment, attribué lui-même le droit de créer un tribunal spécial pour juger un crime relevant du droit national. Ces nouveaux rôles du Conseil de sécurité respectent-ils le principe de légalité ? Cette question sera analysée avec l’exemple de deux pays : le Liban et le Soudan.
Abstract
While it was previously only a "co-producer" of international (criminal) law, the role of the Security Council has now become quite different. It is indeed necessary to highlight the question whether the Security Council exercise a function of prosecutor, judge, and/or legislator. On the one hand, the International Criminal Court Statute gives to the Security Council the power to refer a situation to the Prosecutor for investigation. The Council can also stop an investigation or a prosecution for a period of 12 months renewable. This suggests that we can today speak of a "Security Council-Prosecutor". On the other hand, the "fight against terrorism" is symptomatic of the move towards a Security Council-judge and -legislator. Indeed, in this context, the Council has arrogated to itself the right to create a special tribunal in order to prosecute a national crime. What is the status of these new roles of Security Council with regard to the legality principle? This question will be analysed with the example of two countries: Lebanon and Sudan.
