Résumé
Depuis sa création, le mandat en cas d’inaptitude a suscité plusieurs interrogations quant à son application. En effet, la controverse entourant la nature juridique du mandat donné en prévision de l’inaptitude constitue toujours un débat d’actualité. Constitue-t-il un véritable régime de protection ou un contrat ? Ni la doctrine ni la jurisprudence ne s’entendent sur ce point. Pourtant, les récents développements jurisprudentiels démontrent une tendance vers la thèse contractuelle. Si cette tendance devait se maintenir, l’intervention du législateur demeure souhaitable afin de combler les vides juridiques existants dans le Code civil du Québec au chapitre du mandat donné en prévision de l’inaptitude.
Abstract
Since their introduction, mandates given in anticipation of the mandator’s incapacity have given rise to certain interrogations regarding their application. The juridical nature of this type of mandate is an ongoing subject of debate. Is it a form of protective supervision or is it basically a contract? Legal writers and court decisions offer contradictory points of view. Nevertheless, a study of recent jurisprudence appears to suggest a preference for the contractual thesis. If indeed this trend persists, the writer proposes that legislation be passed in order to correct certain lacunae in the Civil Code chapter dealing with mandates given in anticipation of incapacity.
