Le projet de loi n° 107 portant réforme du droit des successions, qui devrait constituer à brève échéance le Livre troisième du Code civil du Québec, tend à modifier à maints égards le droit actuel, tant dans la présentation des règles que dans leur substance. L’auteur procède à l’analyse de ces modifications, en examinant successivement les six titres du projet de loi, dont quatre sont communs aux successions testamentaires et aux successions ab intestat.
Abstract
Bill 107, to add the reformed law of successions to the Civil Code of Québec, leads to bring important modifications to the present law. There would be numerous modifications to the substance of the rules, and their arrangement itself would be new, especially because of the integration of the rules of intestate succession and those of testamentary succession. The author makes a survey of those modifications, in analysing successively the six titles of the Bill.
