Résumé
Ce chapitre introductif cartographie l’architecture politique et juridique globale sous-jacente de ce que les médias ont nommé la crise des migrants ou des réfugiés au Moyen-Orient. Au-delà des tropes annonçant le dépassement ou l’affaiblissement de la souveraineté, l’effondrement de la raison humanitaire européenne ou un énième échec des Nations Unies, voire du système international de protection des droits de la personne, la crise des réfugiés met en lumière le biais étatiste des réponses politiques et légales à cette crise. Ce chapitre s’entend donc comme une description de la raison souveraine, celle-là même qui gouverne la réponse humanitaire à la crise des réfugiés. La première partie identifie trois séries de stratégies ou dispositifs politiques déployés par les États qui contribuent à renforcer ce préjugé étatiste. La seconde s’attarde à cartographier les ressources juridiques mobilisées par les États qui concourent, elle aussi, à renforcer le préjugé étatiste de la réponse humanitaire. Que ce soit du point de vue des cadres normatifs déployés ou des réponses politiques mises en oeuvre, tout mène à la (re)production du préjugé étatiste du droit international et, ultimement, à la sanctuarisation de la souveraineté dans les relations internationales. Ultimement, il s’agira d’évaluer dans quelle mesure le droit international contribue à la protection des migrants ou, au contraire, fragilise leurs statut et condition.

Abstract
This introduction maps the broader political and legal architecture underlying what the media has dubbed the migrant or refugee crisis in the Middle East. Beyond tropes proclaiming the loss or weakening of sovereignty, the collapse of European humanitarian reason, or yet another failure by the United Nations or the international human rights system, the refugee crisis has exposed the statist bias at play in political and legal responses to the crisis. This introduction is an attempt to define sovereign reason—the very principle that governs the humanitarian response to the refugee crisis. Be it the normative frameworks deployed or the policy responses implemented, everything contributes to the (re)production of state bias in international law. Ultimately, it will be a matter of assessing the extent to which such law helps protect migrants or, on the contrary, further jeopardizes their status and situation.

Este capítulo introductorio traza un panorama de la arquitectura política y jurídica global subyacente a lo que los medios de comunicación han llamado la crisis de los migrantes o refugiados en Oriente Medio. Más allá de los tropos que anuncian la superación o el debilitamiento de la soberanía, el colapso de la razón humanitaria europea o un nuevo fracaso de las Naciones Unidas o incluso del sistema internacional de protección de los derechos humanos, la crisis de los refugiados pone de manifiesto el sesgo estatista de las respuestas políticas y jurídicas a esta crisis. Esta introducción se entiende, por lo tanto, como una descripción de la razón soberana, la razón misma que rige la respuesta humanitaria a la crisis de los refugiados. Ya sea en términos de los marcos normativos desarrollados o de las respuestas políticas implementadas, todo contribuye a la (re)producción del prejuicio estatista del derecho internacional. En última instancia, se trata de evaluar en qué medida este derecho contribuye a la protección de los migrantes o, por el contrario, debilita su situación y condición.
