Résumé
La collaboration du Droit international (DI) et des Relations internationales (RI) est un défi en soi. En plus, la façon dans laquelle elle a été construite et une image statique du DI empêchent son développement. La considération des contributions du DI et une définition qui saisit l’aspect dynamique des phénomènes juridiques ouvrent de nouvelles pistes d’analyse, dont celle de l’interprétation de normes. Nous suivons cette approche interdisciplinaire pour comprendre l’application inconsistante des clauses démocratiques. L’analyse des éléments de l’interprétation – la norme, la situation factuelle et l’interprète – permet de distinguer les facteurs intervenant, ainsi que la nature des obligations des clauses démocratiques. Les divers engagements normatifs expliquent l’association de ces éléments et fournissent la logique d’application des clauses démocratiques.

Abstract
Linking International Law (IL) and International Relations (IR) is a significant challenge in itself. In addition, the way this linkage was constructed and the use of of IL simply as to written norms hamper its development. Building on insights from IL and using a definition that captures the dynamic aspect of legal phenomena open new analytical perspectives, including the one of interpretation of international norms. We adopt this interdisciplinary approach to understand the inconsistent application of democratic clauses. The analysis of the elements of the interpretation process – the norm, the factual situation, and the interpreter – allows for distinguishing both the intervening factors and the nature of the concerned legal obligations. Different normative engagements explain how those elements combine and provide the frame for application of democratic clauses.

Resumen
La asociación del Derecho Internacional (DI) y de las Relaciones Internacionales (RI) constituye un desafío en sí mismo. Pero además, la forma en la que esa relación fue construida, así como y una imagen del DI limitada a la norma escrita impiden su desarrollo. La consideración de las contribuciones del DI y el uso de una definición que comprenda el aspecto dinámico de los fenómenos jurídicos abren nuevas perspectivas de análisis, como por ejemplo la de la interpretación de las normas internacionales. Desde ese perspectiva, abordamos el problema de la aplicación inconsistente de las clausulas democráticas. El análisis de los elementos de la interpretación – la norma, la situación fáctica y el intérprete – permite distinguir los factores intervinientes, así como la naturaleza de las obligaciones de las clausulas democráticas. Los diversos compromisos normativos explican la asociación de esos elementos y proveen la lógica de la aplicación de tales normas.
