Résumé
Le traitement de la question du jus post bellum dans le milieu de la recherche est récent, car cette notion a véritablement émergé après les interventions au Kosovo (1999) et en Irak (2003). C’est la raison pour laquelle la définition de cette notion reste abstraite. Il est nécessaire de faire un travail conceptuel et normatif pour en définir la substance, et cela ne peut être envisagé qu’en se détachant d’un point vue moral et d’une supposée filiation avec les auteurs classiques du droit des gens, pour déboucher sur une analyse positive, politique, juridique et libérale de cette doctrine afin de savoir dans quelle mesure elle trouve son application dans des situations post-conflictuelles particulières ou générales.

Abstract
The treatment of the question of jus post bellum in academia is recent, as this concept has really emerged after the interventions in Kosovo (1999) and Iraq (2003). This is why the definition of this concept remains abstract. It is necessary to make conceptual and normative work to define the substance, and this can only be considered as a point of standing out morality and a supposed ancestral lineage with the classic founders of international law to lead to a positive legal policy analysis and a liberal doctrine to determine in what extent it can be applied in specific or general post-conflict situations.

Resumen
El tratamiento de la cuestión del jus post bellum en el mundo de la investigación es algo reciente, ya que dicha noción emergió verdaderamente luego de las intervenciones en Kosovo (1999) y en Irak (2003). Razón por la cual su definición es aún abstracta. Por ello es necesario hacer un trabajo conceptual y normativo para definir su sustancia, y ello sólo puede lograrse habiéndose uno desvinculado del punto de vista moral y de la supuesta filiación con los autores clásicos del Derecho Internacional, de modo de conseguir un análisis político-legal positivo y una doctrina liberal que determine en qué medida puede ser aplicada la noción a situaciones generales o particulares de situaciones post-conflicto.
