Résumé
Cet article décrit la méthodologie utilisée dans la recherche en droit et l'applique à l'étude de certains aspects du droit de refus d'exécuter un travail dangereux reconnu dans la Loi sur la samé et la sécurité au travail. En ce faisant, l'auteur démontre comment un phénomène social donné constitue aussi un sujet d'étude à caractère juridique. Il établit de plus les limite:; de sa démarche scientifique. Dans cette perspective, l'article soulève plusieurs questions auxquelles le droit ne peut répondre et qui doivent néanmoins être documentées afin de comprendre le droit de refus d'une façon plus complète. Seule la recherche en sciences sociales peut fournir des éléments de réponse à ces questions.
Summary
This paper describes the methodology used in legal research and applies it to the study of certain aspects of the right to refuse to carry out dangerous jobs as recognized in the Quebec law on occupational health and safety. In so doing, the author demonstrates how a given social phenomenon also constitutes the subject for a study of a legal nature. He also establishes the limits of this scientific approach. From this perspective, the paper brings up several questions to which law does not have an answer, but which must nevertheless be documented in order to understand more completely the right to refuse. Only research in the social sciences can supply some elements of response to these questions.
Resumen
Este artículo describe la metodología utilizada en investigaciones de Derecho y la aplica al estudio de ciertos aspectos del derecho de negativa a ejecutar un trabajo peligroso reconocido en la Ley sobre la salud y la seguridad laboral. De esta manera, el autor demuestra como un fenómeno social cualquiera constituye un tema de estudio de carácter jurídico. El establece además, los limites de su proceder científico. En esta perspectiva, el artículo provoca muchas interrogantes a las que el derecho no puede responder y que deben al menos ser documentadas con el fin de comprender de una manera más completa el derecho de negativa. Solo la investigación en ciencias sociales puede aportar elementos de respuesta a estas interrogantes.
