Résumé
Notre examen de la mise en oeuvre de la Convention relative aux droits de l’enfant permet de déterminer si celle-ci a des effets juridiques ou autres dans l’ordre juridique interne. Cette question se décline différemment selon le système juridique particulier à chaque pays. La Belgique fait partie du système moniste, ce qui implique l’effet direct ou l’applicabilité directe d’une convention internationale. Ceci permet d’invoquer une ou plusieurs de ses dispositions directement devant le juge belge sans qu’il ne soit nécessaire de transposer la convention en droit interne par une loi nationale. Or, l’invocation devant les tribunaux belges de la Convention relative aux droits de l’enfant n’est pas automatique ni toujours possible. La jurisprudence belge, loin d’être cohérente, a précisé quelles dispositions de la Convention peuvent être invoquées.
Abstract
Our review of the implementation of the Convention on the Rights of the Child allows us to determine if this Convention has a legal or other effect in domestic law. The answer to this issue varies, depending on the particular legal system of each country. Belgium is part of the monistic system, which implies the direct effect or the direct applicability of international treaties. This allows invoking one or more provisions of the Convention directly before the Belgian judge without the need to transpose the Convention into domestic law by national legislation. However, the invocation of the Convention on the Rights of the Child before Belgian courts is not automatic nor always possible. Belgian law cases, far from consistent, have specified the provisions of this Convention that could be invoked.
