La question de la place de la faute dans la théorie de la responsabilité internationale des États est sans aucun doute une vexata quaestio. En effet, le débat sur les fondements de la responsabilité internationale a profondément divisé les auteurs depuis l’émergence du droit international en tant que discipline autonome à partir de la seconde moitié du XVIIIe siècle. Pour les uns, l’unique fondement de la responsabilité est l’iniuria, le fait illicite. Pour d’autres, en plus de l’iniuria, il faut un mens rea de son auteur. Cependant, la virulence du débat doctrinal contraste avec la démarche de la jurisprudence. La Commision du droit international, elle, a voulu éviter la controverse en affirmant le principe d’une responsabilité objective. Le débat semble donc définitivement clos. Or, un examen approfondi des articles sur la responsabilité des États adoptés en 2001 montre que toute idée de faute en tant qu’attitude psychologique, n’a pas complètement disparu de la théorie de la responsabilité. Cet article a pour objectif de retracer les origines de la controverse sur la question de la faute depuis le droit romain jusqu’à l’époque contemporaine en passant par la doctrine du droit des gens. Il démontre également en quoi la faute survit toujours derrière le fait illicite.
Abstract
Accountability ans its status undoubtedly remains a vexata quaestio, when it comes down to the theory of states international responsibility. Indeed, the debate on the bases of the international responsibility deeply divided authors since the emergence of the international law as an autonomous discipline starting from second half of the 8th century. For some, the responsibility is solely based on the "iniuria", the illicit fact. For others, it is the sum of the iniuria and the mens rea. However, there is a sharp contrast between the doctrine framework and the jurisprudence apparatus. The International Law Comission wanted to avoid the controversy by asserting the principle of an objective responsibility. Thus, the debate seems to be a closed case. But a thorough examination of the articles about states responsibility adopted in 2001 shows that the psychological still remains as an important element in the theory of responsibility. This article aims to recall the origins of the controversy on the question of accountability since the Roman law until the contemporary time while passing by the doctrines of the law of nations. It also shows how the fault always survives behind the illicit fact.
