Résumé
En droit international, il existe une littérature abondante concernant le rapport de force entre la propriété intellectuelle et les droits de l’homme. Pourtant, peu d’études se sont attachées à ce jour à examiner de façon systématique et exhaustive les différents points de rencontre entre le droit à la santé et le droit des brevets. Les auteurs proposent dès lors d’aborder la problématique de façon globale, en tenant compte des développements scientifiques et politiques les plus récents. Alors que le droit à la santé est un concept éthéré, alimenté par des normes qui tiennent plus souvent de la recommandation que de l’obligation juridique ferme, le droit des brevets est consacré depuis longtemps par des textes contraignants et il est généralement présenté comme un instrument permettant de stimuler l’inventivité et le progrès, grâce à un mécanisme de droits exclusifs qui restreignent temporairement l’utilisation de l’innovation en faveur de l’inventeur. Partant, il est donc légitime de se demander si le droit des brevets permet, même indirectement, de servir le droit à la santé en stimulant la recherche biomédicale, ou si au contraire il lui nuit en privatisant les innovations utiles en santé et les produits qui en sont issus. Pour tenter de répondre à cette question, l’article aborde différents enjeux, suivant à la fois les domaines d’application, soit l’accès aux produits de santé et l’innovation, et les pays en cause – États développés ou en développement. Sans chercher à porter un jugement définitif sur la valeur intrinsèque du système des brevets et son apport au domaine des soins de santé, les auteurs constatent néanmoins que la globalisation a occasionné l’importation de règles de propriété intellectuelle dans des pays qui ne possèdent pas nécessairement les infrastructures requises pour retirer les bénéfices pour la santé qui y sont généralement associés. Il serait pourtant possible de répartir plus équitablement les fruits de la mondialisation en faisant de la santé une priorité globale, à la fois instrument et expression de la solidarité humaine.
Abstract
There exists a vast doctrinal corpus concerning the existing tensions between intellectual property and human rights. However, few studies have thus far carried out a comprehensive analysis of the various meetings between the right to health and patent law. The authors therefore propose a global approach of the problematic, in light of recent scientific and political developments. On the one hand, the right to health is a contemporary and still ambiguous concept, which is more often expressed in non-binding declarations and recommendations than in formal international conventions. Its application thus raises important issues. On the other hand, patent law dates back more than five centuries and is internationally enforced by way of binding conventions, treaties, and bilateral agreements. It is generally characterized as a mechanism that stimulates inventiveness and that promotes progress by granting the patent owner exclusive rights over the use of an innovation. This means that patents can have the effect of restricting the use of inventions by third parties. Does patent law thus facilitate, even indirectly, the realisation of the right to health by stimulating biomedical research or does it hinder it by privatising innovations, including the products that originate from these innovations, which are useful for healthcare? In order to bring light on this important thematic, issues pertaining to the enforcement of patent law in both developed and developing countries will be discussed, in terms of access to healthcare products and innovation. Without purporting a value judgement on the intrinsic worth of the patent system, the authors nevertheless argue that globalisation has occasioned the importation of intellectual property rules into countries that did not necessarily possess the required infrastructure to reap the benefits for health generally associated with those rules. However, it is possible to more equitably share the advantages of globalisation by making good health, which is both an expression of and a means to human solidarity, a global priority.
