Résumé
L’auteur nous fait part des débats qu’a suscité la décision du Conseil européen de rédiger une Charte des droits fondamentaux de l’Union européenne. Certains prétendaient que ce texte comblerait un vide et que l’époque était propice à une réaffirmation solennelle des grands principes humanistes. D’autres, qui étaient attachés à la Convention européenne des droits de l’Homme, croyaient que la Charte ne ferait qu’affaiblir le « système » en créant des standards différents. Malgré les inquiétudes, on procéda à la rédaction du texte et la Charte fut approuvée, signée et proclamée en décembre 2000.
Bien que l’influence de la Convention ait été considérable, les deux textes comportent des différences notables. La différence principale entre la Convention et la Charte est que la première s’applique aux États alors que la seconde s’applique à l’Union. De plus, la première ne concerne que les droits civils et politiques alors que la seconde porte également sur les droits économiques et sociaux. L’auteure traite enfin en profondeur les droits qui sont protégés par la Charte, la force juridique de cette dernière et finalement ce que l’avenir lui réserve.
Abstract
The author informs us of the debates that occurred when the European Council decided to draft a Charter of fundamental rights of the European Union. Some said that this text would fill a gap and that the era was favourable to an official reaffirmation of the great humanist principles. Others, attached to the European Convention of Human Rights, believed that the Charter would only weaken the “system” by creating different standards. Despite some concerns, they proceeded to the drafting of the text and the Charter was approved, signed and declared in December 2000.
Although the influence of the Convention was considerable, both texts involved notable differences. The principal differences between the Convention and the Charter is that the first one is only applicable to States when the second applies to the European Union. Furthermore, the former only protects civil and political rights whereas the latter also protects economic and social rights. The author discusses in detail the rights that are protected by the Charter, its legal value and finally what the future holds for it.
