Résumé
La grève étudiante du printemps 2012 a été l’occasion d’une judiciarisation. C’est dans ce contexte que cet article propose une réflexion sur différentes façons d’encadrer le droit de grève des étudiants québécois. S’appuyant sur le droit des contrats, fondement de la jurisprudence issue du printemps 2012, les mesures proposées visent à permettre un respect de l’autonomie des acteurs concernés. Dans une première partie, le présent article expose l’état du droit relatif au contrat étudiant-établissement et au pouvoir de l’établissement d’enseignement de suspendre des cours. La seconde partie analyse des façons d’inclure à ce contrat une clause permettant ou obligeant la suspension des cours en cas de vote de grève.
Abstract
The student strike which occurred in the spring of 2012 resulted in a strong reliance on the courts for resolving several issues arising from this event. In view of this phenomenon, the writers propose various avenues for providing a legal framework to students’ right to strike. Contract law generally served as the basis of various court decisions arising out of these circumstances and will also retained as the foundation of measures proposed by the writers, who seek to promote the autonomy of the various players involved in the strike. The first part of the article describes certain legal facets of contracts between students and educational institutions and examines the power of these institutions to suspend class. The second part analyzes various ways of including in these contracts, a clause which would allow or require the cancellation of classes in case of a student strike.
