Le droit des États-Unis d’Amérique assujettit le « living will » à un régime juridique fortement structuré. À l’inverse, le droit civil québécois ne fait qu’une timide allusion au « living will ». L’objectif visé du présent essai consiste à implanter, dans le droit civil du Québec, le concept de « living will » tel qu’il est actuellement en vigueur en droit américain.

The law in the United States of America defines the « living will » with a legal status strongly structured. Contrarily, Quebec civil law makes only a small allusion of that concept. The persued objective of this study consists to establish in the civil law of Quebec the concept of the « living will » as currently stated in the american law.
