Agriculture definitely is at the top of developmental issues that must be solved if there is to be a future beyond Doha. A new global trade regime, however, needs to go beyond agriculture and deal with the pressing issues of a global economy characterized by unevenness and inequality. Such an agenda would have to simultaneously address the re-establishing of the principle of multilateralism that is endangered not only by regional agreements but also by the desire of non-governmental organizations fighting for labour and environmental standards.

L’article sert d’introduction au sujet sur lequel portent la plupart des articles réunis dans ce numéro. Après une présentation des différents points de vue rapportés en regard de l’échec de Doha, il souligne le besoin de résoudre le problème de l’agriculture pour aller plus avant. Nonobstant l’urgence de cette question, un régime post-Doha doit cependant aussi se pencher sur d’autres questions brûlantes du commerce global tel le rétablissement du principe de multilatéralisme qui est menacé non seulement par l’essor des accords régionaux mais aussi par la lutte des organisations non gouvernementales pour des standards de travail, les questions environnementales etc.

Die Agrarpolitik gehört zweifellos zu den zentralen Problemen, die gelöst werden müssen, wenn es eine Zukunft nach Doha geben soll. Gleichzeitig muss eine neue globale Handelsordnung mehr enthalten und drängende Fragen wie die sich verschärfende internationale Ungleichheit behandeln. Dabei wäre auch das Prinzip des Multilateralismus zu bekräftigen, das nicht nur durch die verstärkte Tendenz zur Regionalisierung, sondern auch durch den Kampf von Nichtregierungsorganisationen für Arbeits- und Umweltstandards in Bedrängnis gerät.

This article empirically examines the WTO’s dispute settlement performance over the past decade. Dispute settlement is the most significant deliverable of WTO governance and embodies all that is both problematic and progressive about that international institution. The article analyzes a number of important and unforeseen institutional consequences of the shift from an informal GATT mechanism to the mandatory norms and processes of WTO litigation. The rise to prominence of antidumping trade remedy action, a retaliatory dynamic of dispute settlement and the continued dominance of developed countries at the Dispute Settlement Mechanism (DSM) has contributed greatly to the current negotiating deadlock.

Cet article examine du point de vue empirique la façon dont l’Organisation Mondiale du Commerce (OMC) a géré les différends entre ses membres au cours de la dernière décennie. Un des éléments-clés de cette politique interne a été l’ « Organe de règlement des différends » (ORD) qui représente un des acquis réels de l’OMC dont les procédés restent en même temps largement déterminés par les pays développés. L’article en arrive à la conclusion que ce manque d’équilibre entre ces derniers d’une part et les pays en développement d’autre part est la raison principale de l’échec des négociations du cycle de Doha.

Der Aufsatz stellt eine empirische Untersuchung der Streitschlichtungspraxis der WHO innerhalb der letzten zehn Jahre dar. Das Streitschlichtungsverfahren ist die bemerkenswerteste Leistung der WHO-Politik und erhellt zugleich den zukunftsweisenden wie den problematischen Aspekt dieser Institution. Der Artikel untersucht eine Reihe wichtiger, aber unvorhergesehener Konsequenzen des Übergangs von dem informellen GATT-Mechanismus zu dem förmlichen, prozedural geregelten Streitschlichtungsverfahren der WHO. Das Überhandnehmen von Antidumping-Verfahren, die Tendenz zu Vergeltungsstrategien sowie die anhaltende Dominanz der Industrieländer innerhalb der Streitschlichtungsverfahren haben entscheidend zur gegenwärtigen Blockierung der WHO beigetragen.

This article takes Canadian trade politics in order to demonstrate that the mixture of multi- and bilateral negotiations is a solution just for yesterday’s problems. First the article provides an account of the present situation of the Doha Development Round. Second it discusses Canada’s interest in bilateral agreements before it analyzes the present conditions for international trade. The final section is dedicated to the political options resulting from that situation.

Zu diesem Zweck wird zunächst ein Abriss des aktuellen Stands der Verhandlungen innerhalb der Doha-Runde gegeben. Sodann wird Kanadas Interesse an bilateralen Abkommen einer kritischen Würdigung unterzogen, bevor auf die aktuellen internationalen Handelsbedingungen eingegangen wird. Der Schlussabschnitt ist den sich daraus ergebenden politischen Optionen gewidmet.

This article first considers the process of competitive liberalization, which has driven the trend toward free trade and which has contributed to further integration of world economies. It illustrates that the trading system is highly competitive, with nations from North America, Europe and Asia seeking to sustain economic growth through greater reliance on export trade and through MNCs’ global value chains of production. The first section emphasizes that regionalism has strengthened worldwide, with the major economic players tending to focus on regional agreements, and more recently, on bilateral agreements. Next, the article discusses regionalization patterns, with an emphasis on the integration taking place in Asia. The major trade bloc in the region, the Association of Southeast Asian Nations (ASEAN), is focusing on increased integration into the global economy. In recent years, it has been promoting trade agreements with Japan, South Korea, and the emerging Asian countries of China and India, among others. Therefore, the article considers whether a new economic pole is emerging in Asia. Last, the difficulties in concluding the Doha Development Round of World Trade Organization (WTO) negotiations and the stalling of those negotiations from July 2006 to February 2007 point to an urgent need for global governance and supportive institutions. This article looks at critical issues in the global system, such as full participation of all players (particularly emerging and developing countries) in the decision-making process of international institutions, and the pursuit of sustainable development. Also, the impact of different cultures of trade will be important factors to consider in order to understand the emerging new world order.

Dans un premier temps, cet article retrace le processus de libéralisation concurrentielle qui tendait vers le libre commerce et une intégration accrue de l’économie mondiale. Il met en évidence que le système de commerce est hautement compétitif avec des pays nord-américains, européens et asiatiques essayant d’augmenter leur croissance économique par le biais du commerce international. Il souligne l’essor du régionalisme soutenu par les économies principales avec une tendance récente aux accords bilatéraux. Dans un deuxième temps, l’article analyse plus particulièrement les structures de régionalisation en mettant l’accent sur l’évolution en Asie. L’accord principal dans la région, ASEAN, vise une intégration accrue dans l’économie mondiale, permettant ainsi de poser la question de savoir si nous assistons à l’émergence d’un nouveau (troisième) pôle économique mondial. Enfin, l’article souligne le besoin urgent d’une gouvernance mondiale soutenue par des institutions appropriées, étant donné l’impasse dans laquelle se trouve le cycle de Doha. Il faut s’assurer d’une participation équitable de tous les pays concernés et de leur développement durable. La prise en considération des différences entre les cultures de commerce régionales sera cruciale pour l’accomplissement d’une telle stratégie.

Der vorliegende Aufsatz untersucht den Prozess konkurrierender Marktliberalisierung, der in Richtung globalen Freihandels und zunehmender ökonomischer Integration treibt. Dabei wird der hochkompetitive Charakter des Handelssystems deutlich, in dem nordamerikanische, europäische und asiatische Länder ökonomisches Wachstum durch verstärkten Außenhandel und über die Wertschöpfungsketten von multinationalen Konzernen herbeizuführen suchen. Im ersten Abschnitt wird gezeigt, dass sich die regionale Integration weltweit verstärkt, wobei die jeweiligen Hauptakteure auf multilaterale, in jüngster Zeit auch verstärkt bilaterale Abkommen setzen. Im nächsten Abschnitt werden Formen der Regionalisierung untersucht unter besonderer Berücksichtigung Asiens. Das wichtigste Handelsabkommen in der Region, ASEAN, strebt eine verstärkte Weltmarktintegration an. In jüngerer Zeit hat es insbesondere Abkommen mit Japan, Südkorea und den Schwellenländern Indien und China vorangetrieben. Infolgedessen geht der Artikel der Frage nach, inwieweit in Asien ein neues Welthandelszentrum entsteht. Abschließend werden die Schwierigkeiten der Doha-Runde und ihr derzeitiger Stillstand als Ausdruck des dringenden Erfordernisses globaler Governance und diese stützender Institutionen gewertet. Der Beitrag untersucht kritische Punkte des globalen Systems wie etwa die volle und gleichberechtigte Teilnahme aller Handelspartner inclusive der Schwellen- und Entwicklungsländer am Entscheidungsprozess der internationalen Institutionen oder die Verfolgung des Ziels nachhaltiger Entwicklung. Des weiteren darf die Bedeutung der Unterschiede in den verschiedenen Handelskulturen nicht verkannt werden, soll es zu einem besseren Verständnis des internationalen Handels kommen.

This article compares regional integration in Europe and Asia and asks for its consequences for multilateral negotiation. First it portrays the present situation in Asia before reminding some major features of the European experience. The main thesis of the article is that we are living in a period of enhanced regionalization. If Europe and the US want to show their ability to deal with the concomitant problems, they have to allow developing countries an equal participation in the determination of the rules and terms of international trade.

L’article se propose de comparer l’intégration régionale en Europe et en Asie du point de vue de ses conséquences pour les négociations multilatérales. Dans un premier temps, il dresse un portrait de la situation actuelle en Asie, avant de rappeler les expériences européennes dans le domaine. Il en arrive à la conclusion que nous vivons une époque de régionalisation accrue. Si les États-Unis et l’Europe veulent se montrer capables de relever les défis qui en résultent, ils doivent permettre aux pays en développement de participer d’une façon équitable à la détermination des règles du commerce international.

Der Artikel vergleicht die regionale Integration in Europa und Asien im Hinblick auf ihre Konsequenzen für den Multilateralismus. Zunächst skizziert er den aktuellen Stand der Entwicklung in Asien und erinnert dann an einige Hauptaspekte der europäischen Erfahrung. Die Hauptthese lautet, dass wir uns in einer Phase verschärfter regionaler Integration befinden. Wenn sich Europa und Amerika als handlungs- und problemlösungsfähig erweisen wollen, müssen sie den Entwicklungsländern einen angemessenen Einfluss bei der Gestaltung des internationalen Handelssystems gewähren.

This article departs from the failing of the Doha Development Round and asks for its consequences for international trade. The official credo of the present trade regime is that free trade lies in the interest of all participants. Historical evidence shows however that all the countries which are economically strong today at some point in their history used measures to protect and enhance their economic development. Insofar as this holds even for the US, the article puts into question the official trade credo. Development of domestic demand is key to successful economic performance and consequently should be a major issue on the political agenda of developing countries.

En mettant en question le crédo plus ou moins officiel qui le caractérise, à savoir la conviction qu’une dérégulation toujours plus avancée des marchés en arrive finalement au bonheur de tout le monde, l’auteur rappelle que les commencements de l’évolution des économies devenues performantes aujourd’hui, y compris celle des États-Unis, étaient marqués par des politiques plus ou moins protectrices. Le développement de la demande domestique en était toujours un élément-clé qui doit conséquemment devenir un objectif crucial des pays en développement.

Ausgehend vom derzeitigen Stillstand der WHO-Verhandlungen fragt der Artikel nach seinen Auswirkungen auf den internationalen Handel. Das offizielle Credo lautet, freier Handel liege im Interesse und sei zum Wohle aller Handelspartner. Eine historische Betrachtung zeigt indessen, dass alle heute erfolgreichen Länder im Verlauf ihrer eigenen Entwicklung protektionistische Maßnahmen ergriffen haben, um ihre wirtschaftliche Entwicklung vor schädlichen äußeren Einflüssen zu schützen. Das gilt auch für die USA, weshalb das genannte Credo unglaubwürdig sei. Eine kräftige Binnennachfrage erscheint im Lichte dieser historischen Erfahrungen als Kernelement erfolgreicher wirtschaftlicher (Nach-) Entwicklung, weshalb dieser Punkt einen prominenten Platz auf der politischen Agenda von Entwicklungsländern einnehmen sollte.

WTO works like any institution following a set of rules and regulations. The article traces this “culture” since its beginnings in the framework of GATT sixty years ago. Even though some of its elements like for example the Dispute settlement mechanism (DSM) are considerable achievements, the present deadlock of the Doha round reveals the need for reform. Various modifications are necessary like for example the abandon of the principle of unanimity in its decision-making process, an enlargement of its agenda from simple liberalization issues to real development politics and the regulation of financial markets and international investment.

L’Organisation mondiale du commerce (OMC) se distingue, comme toute institution, par une série de règles et de modalités de fonctionnement. L’article met en perspective cette « culture » telle qu’elle s’est développée depuis les débuts du GATT il y a soixante ans. Bien que certains de ses éléments comme par exemple l’ « Organe de règlement des différends » (ORD) en constituent des acquis considérables, l’actuel échec du cercle de Doha est révélateur quant au besoin de réformer ce système. Afin de surmonter sa paralysie, il faut envisager l’abandon du principe d’unanimité dans la prise de décisions à l’OMC et étendre sa mission de simple libéralisation des marchés aux politiques de développement et aux problèmes de leur régulation, y compris des marchés financiers et d’investissements internationaux.

Die WHO unterliegt wie jede Institution einem bestimmten Regelwerk. Der Aufsatz beschreibt die Herausbildung dieser „Kultur“ seit ihren Anfängen im Rahmen des GATT vor sechzig Jahren. Auch wenn einige ihrer Elemente wie insbesondere das Streitschlichtungsverfahren als Errungenschaften anzusehen sind, zeigt der gegenwärtige Stillstand der Verhandlungen innerhalb der Doha-Runde den massiven Reformbedarf. Zu den erforderlichen Veränderungen gehört die Aufgabe des Einstimmigkeitsprinzips, die Erweiterung der Agenda von bloßen Freihandelsfragen zu echten Entwicklungskonzeptionen und die Regulierung der internationalen Finanz- und Investmentmärkte.

Given the deadlock of the Doha Round, most of the commentators pointed to the risks of this failure. Contrary to this standpoint, the article sees the abandon of negotiations rather as a chance for escape from a system that did not deliver the outcomes needed. What the future shall bring is first a better equilibrium between trade and financial markets and second a just treatment of developing countries’ interests. The article ends with some propositions in that sense.

Face à l’échec du cercle Doha, la plupart des commentateurs soulignaient les risques qui en découleraient. Contrairement à cette perception de la situation, l’article envisage cet échec plutôt comme sortie heureuse d’un système qui n’arrivait pas à satisfaire aux besoins de tous ses participants. Ce sur quoi il faut désormais mettre l’accent, c’est premièrement l’élaboration d’un meilleur équilibre entre le commerce et les marchés financiers et deuxièmement une juste appréciation des intérêts des pays développés d‘une part et de ceux des pays en développement d’autre part. L’article se termine avec plusieurs propositions allant dans cette direction.

Angesichts des Stillstands der Doha-Runde haben die meisten Kommentatoren auf die Gefahren eines Scheiterns der Verhandlungen hingewiesen. Im Gegensatz dazu wird in dem vorliegenden Aufsatz die Auffassung vertreten, dass hierin eine Chance zur Überwindung eines Systems liegt, das nicht die erforderlichen Lösungen lieferte. Was dringend benötigt wird ist zum einen eine bessere Balance zwischen Handel und Finanzmärkten, zum anderen eine faire Berücksichtigung der Interessen von Entwicklungsländern. Das Ende des Aufsatzes entwickelt einige in diese Richtung gehende Vorschläge.

Malgré une devise commune, dans l’Union européenne les régimes d’imposition restent le domaine souverain des pays membres. Il s’ensuit non seulement une situation de concurrence fiscale mais aussi des régimes d’imposition ayant pour objectif premier d’attirer des fonds d’investissement. Ainsi avec en son sein le Luxembourg comme membre fondateur et la nouvellement admise République de Malte, l’Union européenne cultive une contradiction entre les principes de droit qui régissent les États et les souverainetés offshore qui cherchent précisément à les contourner. Cela se fait non sans un certain nombre de contorsions qu’il devient de plus en plus difficile pour elle de justifier.

The European Union has the Euro but fiscal policy in terms of tax policy remains for the time being a domain of the member states. This entails not only a situation of fiscal competition, but some of them engage in simple tax-dumping in order to attract (in various cases dubious) foreign investment. Luxemburg and Malta are taken here for examples to highlight the contradiction between principles of law which should govern states and an “offshore sovereignty” seeking precisely to circumvent both of them. This makes necessary a certain number of contortions on behalf of the European Union that become ever less justifiable.

Die EU verfügt zwar über eine gemeinsame Währung, aber nicht über eine einheitliche Steuerpolitik, die vielmehr nach wie vor Sache der Mitgliedsstaaten ist. Das führt nicht nur zur Steuerkonkurrenz untereinander, sondern auch dazu, dass einige von ihnen durch Steuerdumping große Mengen ausländischen Kapitals aus zudem oft fragwürdigen Quellen anziehen. Malta und Luxemburg dienen im vorliegenden Aufsatz als Beispiele, um den daraus resultierenden Widerspruch zwischen Rechtsstaatsprinzipien einerseits und einer Logik der offshore-Souveränität andererseits aufzuzeigen. Um diesen Widerspruch nach außen nicht zu scharf hervortreten zu lassen, sieht sich die EU zu einer Reihe von argumentativen Verrenkungen genötigt, die immer unglaubwürdiger werden.

Dieser Aufsatz skizziert aus ethnologischer Sicht die Zweideutigkeit der Europäisierung, und zwar am Beispiel Portugals: Europäisierung im Sinne von Portugals Annäherung an und Integration in Europa, aber auch Europäisierung im Sinne von Portugals Einfluss auf Europa. Die Agrarpolitik und insbesondere die in Portugal beobachtbare Schaffung von durch die EU geförderten Eukalyptus-Plantagen dienen als eines der Beispiele, an denen die Chancen, aber auch die Gefahren der Europäisierung deutlich werden: die Kunst besteht darin, ihr Potential zu nutzen, ohne ihr Opfer zu werden.

Cet article se propose de retracer d’un point de vue ethnologique l’européisation à l’exemple du Portugal. Il adopte le double point de vue de l‘européisation au sens de l’intégration et du rapprochement du Portugal à l’Europe d’une part et au sens de l’influence exercée par celui-là sur celle-ci d’autre part. La politique agricole du Portugal et la promotion des cultures d’eucalyptus, largement soutenue par l’Union européenne, sert d’exemple pour mettre en évidence les défis de cette double européisation à relever par les pays membres.

This article undertakes from an ethnological perspective to portray the double-sense of Europeanization in the light of Portugal’s experience: Europeanization in the sense of Portugal’s approach to Europe and integration in it on the one hand, but also Europeanization in the sense of Portugal’s impact on Europe on the other hand. Agricultural politics and more specifically the promotion of eucalyptus plantations as has been pushed forward by the European Union serve as an example for the challenges of Europeanization: to benefit from it and not to become its victim.

Cet article a pour point de départ l’incapacité de la politique actuelle de l’OMC de fournir des réponses aux questions brûlantes de la mondialisation. Le blocage des négociations à l’OMC devrait être l’occasion de repenser réellement la régulation du commerce international. Celle promue par l’OMC jusqu’ici a montré ses limites : basée sur le libre-échange, elle n’a pas permis de dégager un accord entre des pays de natures différentes et qui ne consentiront pas à se plier à une idéologie qui n’aura pas su convaincre. Le commerce international doit être subordonné à des règles et ne doit pas primer sur des droits plus fondamentaux (économiques, sociaux et culturels). Au minimum, la hiérarchie des normes internationales doit être rétablie, de sorte que celles du commerce international ne priment pas de fait sur toutes les autres. La question de la coopération doit être posée et devrait certainement se substituer au dogme du libre-échange qui n’a jamais démontré qu’il était l’alpha et l’oméga du développement.

This article departs from WTO’s lack of ability to solve the problems of globalization. The deadlock of the Doha round is seen as an opportunity to rethink the need for international trade regulations. WTO’s history has shown the limits of its own practices: based on the credo of free trade, it was unable to draft an agreement between considerably different countries some of which do not accept the prevailing ideology. International trade should be subjected to rules and should not be allowed to efface fundamental rights (economic, social, and cultural). The bottom-line is that the hierarchy of international norms has to be reestablished in order to prevent those of international trade to prevail over the others. Questions of international cooperation have to be on the agenda and replace those of free trade which could never show their pertinence for development.

Der Artikel befasst sich mit der offenkundigen Unfähigkeit der WHO, die durch den Globalisierungsprozess hervorgerufenen Probleme zu bewältigen. Er sieht den Stillstand der Verhandlungen innerhalb der Doha-Runde als Chance an, um zu einer effektiven und gerechten internationalen Handelsordnung zu gelangen. Die Geschichte der WHO belegt die begrenzte Reichweite ihres Wirkens: dem Credo uneingeschränkten Freihandels verschrieben, war die Institution nicht dazu in der Lage, ein Abkommen zwischen den sehr unterschiedlichen Teilnehmerländern zu realisieren, von denen zahlreiche die Freihandelsdoktrin auch gar nicht (mehr) teilen. Internationaler Handel muss bestimmten Regeln folgen und darf nicht auf Kosten von Grundrechten gehen, mögen sie ökonomischer, sozialer oder kultureller Art sein. Es muss zumindest eine gewisse Hierarchie internationaler Normen wiederhergestellt werden, so dass diejenigen des Handels nicht andere ausstechen. Fragen internationaler Kooperation müssen auf der politischen Agenda diejenigen des Freihandels ersetzen, der zudem nie seine Einschlägigkeit für erfolgreiche und nachhaltige ökonomische Entwicklung aufzeigen konnte.
