Droit et décroissance : l’exploration des possibles juridiques

Résumé

La décroissance est encore très peu familière aux juristes, surtout dans le milieu francophone. Or elle commence à entrer dans le champ académique et retient de plus en plus l'attention des décideurs politiques. Dans la mesure où la possibilité d'une politique juridique décroissancielle existe, il est du devoir des juristes de penser cette possibilité. Cet article résume les débats qui ont pris place lors des journées d'étude des 16 et 17 mai 2023 organisées en collaboration par l'Université du Luxembourg et l'Université de Montréal intitulées « Décroissance et droit : poursuivre l'exploration des possibles juridiques ». Comme celles-ci, il est structuré autour de quatre thèmes : le rapport à la nature, à l'espace, au temps ainsi qu'à soi-même et aux autres.

Abstract

Degrowth is still unfamiliar to legal professionals, especially within the French-speaking community. However, it is beginning to enter the academic field and is increasingly attracting the attention of political decision-makers. Given that the possibility of a degrowth legal policy exists, it is the duty of legal professionals to consider this possibility. This article summarizes the debates that took place during the study days on May 16 and 17, 2023, organized in collaboration by the University of Luxembourg and the University of Montréal, titled 'Degrowth and Law: Continuing the Exploration of Legal Possibilities.' Like these study days, the article is structured around four themes: the relationship with nature, space, time, as well as with oneself and others.
