Résumé
L’auteur analyse la décision rendue par la Cour d’appel dans Champagne et al. c. Cégep de Jonquière et CRTC et son impact. La question principale qui découle de cet arrêt est la suivante : le contenu d’un contrat d’assurance de responsabilité est-il confidentiel ou non ? La Cour d’appel conclut qu’il n’a pas un caractère confidentiel mais que l’assureur doit avoir l’opportunité de demander au tribunal l’autorisation de garder confidentielles certaines parties du contrat.
Abstract
The author examines the decision of the Quebec Court of Appeal Champagne et al. v. CEGEP of Jonquiere and CRTC and its impact. The important question arising from this case is the following: is the civil liability insurance policy confidential or not? The Court of Appeal stated that said policy is not confidential. However, the insurer could ask the Court to restrict such authorizarion to particular part of the policy.
