Une convention spécifique aux personnes âgées ? Contribution au débat A specific convention for the older persons? Contribution to the debate

Résumé

Durant la décennie 2010-2020 j’ai été une actrice, en tant qu’adjointe du Défenseur des Droits (DDD) de la France en charge de la mission de lutte contre les discriminations, de la montée en puissance de la préoccupation pour le respect des droits fondamentaux et de la poursuite de l’exercice d’une pleine citoyenneté pour les personnes qui avancent en âge.

Le débat autour de cette question a été conduit au plan national, européen et international, s’appuyant sur le cadre normatif existant à ces échelles et posant la double question de l’appropriation de ce corpus actuel de droits et de l’éventuelle nécessité d’élaborer une convention internationale spécifique aux personnes âgées.

M’appuyant sur mon expérience au sein de deux autorités indépendantes (la Haute Autorité de lutte contre les Discriminations et pour l’Egalité (HALDE) et le DDD) j’apporte ici ma contribution à une fresque historique et dialectique, avec les avis de toutes les parties prenantes, débouchant sur le constat des efforts à fournir pour promouvoir et investir au mieux le corpus normatif déjà existant dans un contexte européen où le recours aux juridictions supranationales est possible.

Abstract

Between 2010 and 2020, as deputy of the French Defender of Rights (DDD) in charge of the anti-discrimination mission, I have been involved in the action in favour of a better concern for the respect of fundamental rights and the pursuit of full citizenship for people who are ageing.

The debate around this issue has been carried out at the national, European, and international levels, and raises the question of the appropriation of the already existing bodies of rights at these scales or the need to elaborate an international convention specific to the elderly.

Based on my experience within two independent authorities (the High Authority against Discrimination and for Equality (HALDE) and the DDD), I present here a historical overview of the positions of all the stakeholders in these discussions. I then conclude by noting the efforts that need to be made to promote and invest the existing body of normative law as best as possible, even more so in a European context where supranational jurisdictions can be invoked.
