Le 8 juillet 2016, la Cour suprême du Canada rendait l’arrêt R. c. Jordan, dans lequel elle fixait la durée maximale d’un procès à 18 mois pour les procès criminels instruits devant une cour provinciale et à 30 mois pour ceux qui le sont devant une cour supérieure (ou ceux instruits devant une cour provinciale à l’issue d’une enquête préliminaire). Cet arrêt ayant provoqué une onde de choc sur le système de justice criminelle, il convient d’examiner les fondements d’un tel jugement. Au-delà du droit constitutionnel et du droit criminel, l’arrêt Jordan est un jugement issu du droit de la gouvernance. Dans la perspective de cette transformation récente du droit, l’auteur propose dans son article une double lecture de cet arrêt : soit c’est une conception économique du droit de la gouvernance, fondée sur l’efficacité de la gestion du système judiciaire ; soit il s’agit d’assurer l’effectivité du droit d’être jugé dans un délai raisonnable et de provoquer un changement de culture juridique, au sens de la conception génétique de la gouvernance.
Abstract
On July 8th, 2016, the Supreme Court of Canada rendered its ruling in the Jordan case, in which the Court determined that the presumptive ceiling is 18 months for criminal cases tried in the provincial court, and 30 months for those in the superior court (or cases tried in the provincial court after a preliminary inquiry). Because this judgment sent a shock wave through the criminal justice system, it is relevant to study this ruling’s foundations. Beyond constitutional and criminal law, the Jordan case is also rooted in the law of governance. In light of this recent transformation of the law, the following article offers a twofold interpretation of the Jordan case: this court ruling may represent an economic conception of governance law, based on the efficiency of the judicial system’s management; or, the Court’s goal may be to ensure the effectivity of the right to be tried within a reasonable time and to generate a legal culture change, within the meaning of the genetic conception of governance.
