Résumé
La corégulation est promue par la Communauté européenne comme un instrument de « bonne gouvernance ». Notre analyse tend à montrer la distance entre le discours sur la corégulation et la réalité de sa pertinence pour mettre en oeuvre une politique environnementale ambitieuse et démocratique. Les limites de la corégulation à cet égard sont clairement dévoilées lorsqu’elle est utilisée comme un substitut à une réglementation que l’autorité publique concernée ne peut ou ne veut pas adopter. En revanche, lorsqu’elle est utilisée dans un cadre réglementaire, la corégulation apparaît comme une méthode intéressante pour accroître la participation des destinataires et la flexibilité de la norme.

Abstract
Coregulation is hardly promoted by the European Community as a “good governance” tool. This analysis highlights how far the reality suits the discourse when coregulation is at stake.When coregulation is used as a substitute to classical regulation that the public authority does not want or can not adopt, it is likely that reality will be far from the theory. This coregulation raises legitimacy issues, and its environmental efficiency is doubtful. On the other hand, when used as a part of a policy mix including classical regulation, coregulation appears as an interesting method to increase participation and flexibility.
