UNE RÉFORME PÉNALE EN AMÉRIQUE LATINE QUI DEVRAIT CHERCHER SA LÉGITIMITÉ

Résumé

La plus grande cause de vulnérabilité des démocraties latino-américaines nous disait Rouquié (Amérique latine : Introduction à l’Extrême-Occident) n’est ni « la résurgence du populisme », les maras, les guérillas, « l’offensive criminelle et corruptrice du narco trafic », « l’afflux de dollars mal acquis », ni même « l’inconséquence de certains hommes politiques », mais la pauvreté et l’aggravation des inégalités sociales qui constituent le principal défi à la stabilité des institutions et à l’État de droit. C’est justement dans ce contexte de re-démocratisation de l’Amérique latine que nous nous sommes attardés à regarder si les réformes juridiques, plus précisément celles pénales généralisées dans toute l’Amérique latine ou presque, ont su apporter avec elles un aspect de développement ou de liberté pour son citoyen. Il nous semblait opportun d’approfondir ce contexte particulièrement à un moment où presque toute l’Amérique latine se lance dans des réformes juridiques importantes mettant devant plusieurs maux le « droit » comme solution aux problèmes laissés par le passé. Nous avons donc proposé de voir si depuis la mise en oeuvre de la plus grande réforme juridique, depuis la mise en place des codes civils au 18^e siècle, si l’Amérique latine a su mettre le citoyen au centre de l’équation droit et développement.

Abstract

The most important cause of vulnerability of Latin-American democracies, according to Rouquié (Latin America: Introduction to the Far West), is not “the resurgence of populism”, the maras, the guerrillas, “the drug traffickers' criminal and corrupt offensive”, “the flow of ill-gotten gains”, nor “the inconsequence of some political leaders”, but rather poverty and the increase of social inequalities, which constitute the main challenge to the stability of institutions and the rule of law (Alain Rouquié, Latin America: Introduction to the Far West, Paris, Seuil, 1987 at 329-330). It is within this context of re-democratization of Latin America that we have analysed whether the legal reforms, especially the criminal ones that are practically generalised throughout the entire region, have brought upon an aspect of development or liberty to the citizen affected by them. It seemed timely to deepen our understanding of this context at a time where almost all of Latin America is adopting legal reforms that place the “law” as a solution to problems brought upon by the past. We have thus offered to explore the question as to whether since the implementation of the largest legal reform, since the implementation of the civil codes during the 18^th century, Latin America has succeeded in placing the citizen at the centre of the law and development equation.

La principal causa de vulnerabilidad de las democracias latinoamericanas según Alain Rouquié (América Latina: Introducción al Far West), no se encuentra en “el resurgimiento del populismo”, o las maras, o la guerrilla, ni siquiera en “la ofensiva criminal y corrupta del narcotráfico”, o “la afluencia de dólares mal habidos”; Tampoco se encuentra en “la inconsecuencia de algunos políticos”. En realidad, la principal causa tiene relación con la pobreza y las crecientes desigualdades sociales, factores que a su vez, constituyen los principales desafíos a la estabilidad de las instituciones y el estado de derecho (Alain Rouquié, 1987, América Latina: Introducción al Far West. París, Edic du Seuil, pág 329-330). Es precisamente en este contexto de redemocratización de América que nos hemos planteado la interrogante sobre si las reformas judiciales, especialmente las reformas procesales penales que se llevan a cabo actualmente en casi toda América Latina, están contribuyendo o no, al desarrollo y la libertad de los ciudadanos. Nos parece oportuno indagar en esta área, considerando el hecho que casi toda América Latina ha entrado en un proceso de reformas jurídicas importantes, utilizando el derecho como solución a los problemas acarreados del pasado.
