Le Conseil de Sécurité des Nations Unies est en train d’établir un Tribunal Spécial pour le Liban, son quatrième tribunal ad hoc. L’expression « international » n’apparaît pas dans le titre du Tribunal, et il a la compétence du juger les violations du droit libanais. Donc, malgré ses multiples similarités avec les tribunaux ad hoc pour l’ex-Yougoslavie, le Rwanda et Sierra Leone, il est unique sous certains égards. Dans le jugement Yerodia, la Cour internationale de justice a dit qu’il n’y avait pas d’immunité pour les chefs d’États devant « certains tribunaux pénaux internationaux », mais sans spécifier les particularités d’un tribunal pénal international. Elle donna en exemple les tribunaux pour l’ex-Yougoslavie et le Rwanda, ainsi que la Cour pénale internationale. Par la suite, la chambre d’appel du Tribunal spécial pour la Sierra Leone affirma qu’elle tombait également dans la même catégorie. Cet article examine la question à savoir si le Tribunal spécial pour le Liban est un tribunal pénal international au même titre que le autres tribunaux ad hoc.
Abstract
The United Nations Security Council is establishing the Special Tribunal for Lebanon, its fourth ad hoc criminal tribunal. The word “international” does not appear in the name of the Tribunal, and it exercises subject matter jurisdiction over violations of Lebanese law. Thus, I though similar in many respects to the ad hoc tribunals for the former Yugoslavia, Rwanda and Sierra Leone, it is unique in some aspects. In the Yerodia judgment, the International Court of Justice said that there was no head of state immunity before “certain international criminal tribunals”, but without specifying the features of an international criminal tribunal. It gave as examples the Yugoslavia and Rwanda Tribunals, and the International Criminal Court. Subsequently, the Appeals Chamber of the Special Court for Sierra Leone claimed that it too ell within the same category. The article examines whether the Special Tribunal for Lebanon is an international criminal tribunal of the same genus as the other ad hoc tribunals.
