LE CONSENTEMENT PRÉALABLE, LIBRE ET ÉCLAIRÉ DES PEUPLES AUTOCHTONES EN DROIT INTERNATIONAL : LA NÉCESSAIRE REDÉFINITION DE SON CADRE CONCEPTUEL

Résumé

Cet article vise à remettre en question le cadre conceptuel dans lequel s’inscrit l’émergence du principe du consentement préalable, libre et éclairé des peuples autochtones en droit international. La littérature majoritaire en la matière considère que ce principe requiert une reconnaissance du droit à l’autodétermination des peuples autochtones de même que leurs droits territoriaux et leur souveraineté permanente sur leurs ressources naturelles. À cet égard, il n’est guère surprenant de constater que ce principe est confronté à diverses forces divergentes qui minent son adoption en droit international à court, moyen et même à long terme. En vertu du droit international public en vigueur à ce jour, les peuples autochtones ne jouissent pas du droit à l’autodétermination. Il en sera probablement ainsi pendant plusieurs décennies et ce, malgré les développements encourageants à cet effet dans le cadre de l’Organisation des Nations unies. Cet article adopte une approche théorique reposant sur les modèles de l’intégrité culturelle et de l’autodétermination afin d’analyser les manifestations de ce principe au sein, inter alia, du système onusien, du système interaméricain, des banques internationales de développement, de même qu’en droit domestique canadien. Il démontre que le principe devrait s’arrimer à des dispositions constitutionnelles et/ou législatives, voire même à des développements jurisprudentiels en droit domestique plutôt qu’à une improbable reconnaissance du droit à l’autodétermination des peuples autochtones en droit international.

Abstract

This paper calls into doubt the conceptual framework through which the principle of free, prior and informed consent of indigenous people in international law has emerged. The majority of the relevant literature considers that the principle requires a recognition of the indigenous people’s right to self-determination as well as their right to their lands and their permanent sovereignty over their natural resources. In that context, it is scarcely surprising to discern various conflicting forces that undermine its adoption in international law in the short, medium and even the long term. In accordance with the public international law currently in force, indigenous people do not benefit from the right to self-determination. That state of the law is likely to endure for decades to come regardless of the encouraging progresses that have been made in that regard in the United Nations context. This paper adopts a theoretical approach that rests on the cultural integrity and the self-determination models with a view of analysing the manifestations of the principle in, inter alia, the UN system, the Inter-American system, the international development banks as well as in Canadian domestic law. It argues that the recognition of the principle should be based on constitutional and/or legislative dispositions, or even case-law developments in domestic law, rather than being geared towards an unlikely recognition of the indigenous people’s right to self-determination.
