Résumé
Au cours de la Guerre froide, la doctrine de l’objecteur persistant fut une réponse politique à certains antagonismes juridiques qui opposaient essentiellement le bloc de l’Ouest au bloc de l’Est, mais également le tiers-monde à l’Occident. La présente étude explore les fondements et le contenu de cette doctrine protojuridique, les exceptions à sa mise en oeuvre et les fonctions exercées par celle-ci dans la société internationale. Rattachée au discours positiviste classique en droit international, la doctrine de l’objecteur persistant souffre cependant d’importantes lacunes et incohérences au plan de l’analyse juridique. Cette situation fait de ladite doctrine un concept juridiquement incertain, mais politiquement effectif, en théorie du moins.
Abstract
During the Cold War, the persistent objector doctrine has been a political response to juridical antagonisms that opposed the Western Bloc to the Soviet Bloc; the Third World to the Occident. The present study explores the foundations and the content of this proto-juridical doctrine, the exceptions regarding its application and the functions fulfilled by the latter in the international society. Tied to the classical positivistic discourse in international law, the persistent objector doctrine suffers nevertheless from important lacunas and incoherence from a juridical perspective. This situation sheds some light on the juridical uncertainties and flaws surrounding the doctrine, but nonetheless the latter remains politically effective, at least in theory.
