Résumé
La préservation des biens culturels met en évidence d’abord un rapport patrimonial et axiologique au passé. Aussi, la reconstruction du centre-ville de Beyrouth pose avec elle la délicate question de la préservation des biens culturels d’une ville qui s’est enrichie avec le temps des vestiges de dix-sept civilisations successives. La récente entreprise de reconstruction menée par la société Solidere soulève plusieurs problèmes non seulement d’un point de vue historique mais aussi d’un point de vue juridique. Sur ce dernier point, c’est principalement la défaillance des ordres juridiques interne et international à préserver des composantes du patrimoine commun à l’humanité qui se trouve en jeu. Travaillant sous l’égide de l’UNESCO, le CSI proposa une démarche qui à l’évidence n’aura pas été suivie par les autorités libanaises. Étant donné que la société Solidere avait pour principal actionnaire le Premier Ministre libanais, la perception de l’intérêt public s’est trouvée dissoute au profit de l’intérêt privé. Pour l’auteur, cette dissolution induit dans un même mouvement celle de la fonction majeure de l’État, qui est d’arbitrer par le droit entre l’intérêt public et l’intérêt privé. Ce problème d’État de droit dans l’ordre juridique interne a également des ramifications dans l’ordre juridique international. Le présent travail tente notamment de soulever un questionnement en ce sens et s’interroge sur la place du droit à cet égard.
Abstract
The preservation of cultural goods first underlines a patrimonial and axiological link to the past. The reconstruction of Beyrouth city-center is of particular relevance and interest because it bears consequences on the preservation of cultural goods which can be associated to the passage of no less than seventeen civilisations. Yet, the recent reconstruction plan undertaken by the Solidere corporation raised many questions not only on an historical or sociological level, but also on a legal one. Indeed, it is mainly the defaults and weaknesses of both national and international legal orders in protecting legimate elements of the patrimoine commun de l’humanité which is at stake here. Elaborated under UNESCO, the CSI recommendations were obviously not followed by Lebanese competent authorities. Since the major shareholder of Solidere was the Prime Minister of Lebanon, the public interest appears to have been dissolved for the benefit of private interest. According to the author, this dilution also affects a major function of the State which consists of being the arbitrator between private and public interest. This problem relates directly to the rule of law not only at a national but also at an international level. Among many other things, the present essay tries to raise the questions concerning the function of law in such matters.
