Résumé
Depuis l’émergence du droit international en tant que discipline autonome au milieu du 18e siècle, la question de son fondement a toujours divisé les auteurs. Elle demeure à n’en pas douter une vexata quaestio. Le paradigme positiviste, s’enracinant dans le nominalisme occamien et dans la théorie de l’État et du droit naturel hobbesien, a emprunté la méthodologie physico-mathématique élaborée par Galilée et surtout Descartes. D’instinct, il s’est rallié au 19e siècle à la tradition volontariste pour laquelle le phénomène juridique se ramène aux actes de volonté des gouvernants. Le droit positif complètement désaxiologisé peut désormais faire l’objet d’une théorie pure. Le fondement du droit international se réduit ainsi à la seule volonté des États, volonté explicite dans le traité et implicite dans la coutume internationale. Cet article vise à montrer les limites de ce paradigme positiviste. Par un réexamen de la métaphysique dynamique d’Aristote, métaphysique de la puissance / acte et de la relation, il propose la systémique comme le modèle qui permet de mieux approcher le droit international dans toute sa globalité et sa complexité.

Abstract
Since the emergence of international law as an autonomous discipline in the middle of the 18th century, the problem of its foundations has always been a matter of dispute among scholars. It remains a vexata quaestio. The positivist school of thought, which had its roots in the nominalism of William of Occam and the doctrine of State and natural law of Thomas Hobbes, developed rapidly in the pragmatic world of the 19th century by using the methodology of natural sciences. The positivism declared that law as it exists should be analysed empirically, shorn of all ethical elements. Law in the society is the positive law. And the foundation of international law is to be found in and only in the will of states. This article aims to show the limits of the legal positivism. By analysing the metaphysics of Aristotle, metaphysics of the final cause, theory of potentiality and actuality, the article explains why it is useful to turn to the systemic approach in international law.
