La culture bijuridique en Louisiane

Résumé

Le développement historique de la Louisiane, État du sud des États-Unis, partie de l’ancienne colonie française du même nom, a conduit à la création d’un véritable système bijuridique. En présentant les diverses transformations du Code civil de Louisiane au cours de l’histoire, l’auteur démontre le grand défi qu’a relevé ce peuple en préservant son caractère culturel singulier. En parallèle avec le droit québécois, cet article rend compte des avantages, en soulignant quelques inconvénients, du système bijuridique louisianais.

Abstract

The historical development of Louisiana, the Southern state and previous French colony of the United States, led to the creation of a true bijudicial system. By presenting the various transformations of the Louisiana Civil Code throughout its history, the author demonstrates how the people of Louisiana took up the challenge of preserving their distinctive culture. In parallel with Québec law, this article highlights the advantages of the bijudicial system, whilst noting some of its downsides.
