Résumé
Cet article s’intéresse à l’application des règles énoncées par la Cour suprême du Canada à l’égard de l’appréciation de la « raisonnabilité » de la décision d’un tribunal administratif faisant l’objet d’un contrôle judiciaire. Elle révèle l’existence d’un écart significatif entre les principes énoncés par la Cour suprême depuis l’arrêt Dunsmuir c. Nouveau-Brunswick et leur application par la Cour d’appel du Québec. Pour y parvenir, l’auteur a d’abord fait une synthèse des règles fondant la détermination de la norme de contrôle judiciaire et de son évolution jurisprudentielle auprès des cours de juridiction fédérale et provinciale. Il s’est ensuite attardé au pouvoir d’intervention des cours judiciaires lors d’un contrôle judiciaire, notamment au regard la norme de la décision raisonnable. Il termine son analyse par une étude comparative des jugements de la Cour suprême avec 82 jugements de la Cour d’appel du Québec contenant l’expression « issues possibles acceptables pouvant se justifier au regard des faits et du droit » mentionnée au paragraphe 47 de l’arrêt Dunsmuir.
Abstract
This article examines the application of the Supreme Court of Canada’s [SCC] guidelines with respect to appreciation of the “reasonableness” of an administrative tribunal’s decision under judicial review. In so doing, it reveals a significant gap between the principles put forth by the SCC since Dunsmuir v New Brunswick and their application by Quebec’s Court of Appeal. The writer begins by summarizing the rules setting the standard relating to judicial review and the evolving manner in which Federal and Provincial courts have applied this standard. He then examines the power of interventions by the courts in light of the reasonableness standard. The writer completes his analysis by means of a comparative examination of judgments of the SCC and eighty-two judgments rendered by Quebec’s Court of Appeal which contain the phrase “[…] possible, acceptable outcomes which are defensible in respect of the facts and law […]”, as found in paragraph 47 of the Dunsmuir decision.
