Résumé
Suite à l’adoption de la Proclamation royale de 1763, les Britanniques nouvellement établis au Québec exigent la convocation d’une Chambre de députés et le droit d’être jugé par un jury protestant. De leur côté, des seigneurs, des juristes et des commerçants francophones déplorent l’abrogation apparente du droit français et l’impossibilité pour les catholiques d’exercer des hautes fonctions publiques. Le gouvernement britannique sollicite ou reçoit des rapports rédigés majoritairement par des juristes britanniques dont certains exercent leurs fonctions dans la colonie. Ces documents procèdent à une comparaison du droit pénal et du droit privé de la Nouvelle-France avec celui de l’Angleterre. Plusieurs recommandent le rétablissement du droit immobilier, successoral et matrimonial antérieur ou l’intégration de règles précises d’origine française dans des ordonnances provinciales exhaustives. La préservation du droit pénal français suscite une très forte opposition. En 1774, des ébauches de projets de loi truffées d’incohérences amènent le gouvernement britannique à conclure que les règles anglaises et françaises ne peuvent être combinées à distance. L’idée d’interdire la consultation de sources françaises est également abandonnée, alors qu’au départ, elle est considérée comme un élément indispensable de la réforme. Le gouvernement est aussi irrité par l’attitude hostile des législatures coloniales américaines, ainsi que par les décisions de jurys défavorables à ses intérêts. En définitive, l’Acte de Québec de 1774 rétablit le droit privé de la Nouvelle-France et maintient en vigueur le droit pénal anglais. Il autorise les catholiques à exercer des fonctions publiques, mais crée un Conseil législatif non élu qui a le pouvoir d’introduire graduellement certaines règles du droit privé anglais.
Abstract
Following the Royal Proclamation of 1763, British subjects newly established in Quebec demanded both the convocation of a legislative assembly as well as the right to trial before a Protestant jury. For their part, Francophone seigneurs, jurists and businessmen lamented the apparent abrogation of French law and the fact that Catholics could not hold high public office. The British government requested or received reports drafted mostly by British jurists, some of whom practised in the colony. These documents compared the criminal law and the private law of New France with that of England. Many recommended that the former rules pertaining to immovables, to successions and to matrimonial regimes be reinstated, or that detailed rules of French origin be integrated into extensive Provincial ordinances. The preservation of French criminal law aroused fierce opposition. In 1774, legislative drafts marred by numerous inconsistencies compelled the British government to conclude that the combination of French and English rules could not be achieved from a distance. The idea of prohibiting the consultation of French legal sources was also abandoned, even though it had initially been considered an essential element of the reform. Furthermore the Government was annoyed by the hostile attitude of the American colonial legislatures and by jury decisions that were contrary to its interests. In the end, the Quebec Act of 1774 reinstated the private law of New France while retaining English criminal law. It authorized Catholics to hold public office, but created an unelected legislative council that had the power to gradually introduce certain English private law rules.
