Résumé
Afin d’apporter un éclairage historique aux débats actuels sur la neutralité de l’État, le présent article retrace l’évolution ou, à tout le moins, une évolution possible, du principe de neutralité de l’État en droit constitutionnel canadien. Les auteurs s’intéressent dans la première partie à la période d’après la conquête alors que la paix religieuse était recherchée. La deuxième partie est consacrée à l’examen des privilèges constitutionnels reconnus par le régime fédéral de 1867. La troisième et dernière partie porte sur l’importante remise en cause de tels privilèges en vertu du régime des droits et libertés constitutionnalisés depuis 1982. Malgré la protection constitutionnelle de la liberté de conscience et de religion ainsi que du droit à l’égalité qui constituent les fondements juridiques de la neutralité de l’État, cette dernière demeure encore aujourd’hui un projet inachevé.
Abstract
In order to present an historical perspective of the current debate relating to the concept of state neutrality, the writers retrace the evolution or, at least the plausible evolution of this principle in Canadian constitutional law. The first part of the article examines the Post-Conquest period where the primary objective was to ensure religious peace. In the second part, the writers review certain constitutional privileges recognized under the federal regime of 1867. The third and final part of the article deals with the re-evaluation of these privileges in light of certain constitutional rights and freedoms in effect since 1982. Despite constitutional protection of the freedom of conscience and religion as well as of the right to equality, which constitute the legal foundations of the principle of neutrality of the state, the notion of state neutrality must still be considered an unfinished project.
