Résumé
Le développement du droit d’auteur a été motivée depuis toujours de façon à bien gérer les rapports délicats entre les auteurs et le public afin de tenir compte des intérêts de chacun. Si le public veut avoir accès au travail de l’auteur en vue de bénéficier des avantages culturels qui y sont transmis, on doit également reconnaître à l’auteur une exclusivité d’exploitation de son oeuvre pour les fins de sa commercialisation. Le concept d’épuisement des droits a cependant été élaboré en vue de tempérer l’exercice exclusif du droit d’auteur. Où se situe le point d’équilibre entre les droits intellectuels et ceux du public dans le respect du libéralisme économique ? L’objectif de ce texte est de répondre à cette question.
Abstract
An important stimulus in the development of copyright law has been the goal of balancing the sensitive relationship between authors and the general public in light of the interests of each. If the public wishes to benefit from the cultural advantages inherent in an author’s work, one must also recognize the author’s right to enjoy exclusive use of his or her work for commercial purposes. However, the concept of copyright exhaustion was created with the intent of limiting copyright exclusivity. How can one balance intellectual rights with the rights of the public while preserving the principles of economic liberalism? The goal of this article is to provide an answer to this question.
