Résumé
Au cours de ce texte, l’auteur aborde le processus de changement relatif à l’étatisation de la justice autochtone paysanne communautaire au sein de l’appareil juridique bolivien. Il relève, dans un premier temps, le fait que ce type de justice bien particulière existe depuis fort longtemps et trace l’historique de la reconnaissance officielle du droit et de la justice autochtone en Bolivie, en mettant l’accent sur les avancées récentes en la matière effectuées par le gouvernement d’Evo Morales Aima. Dans un second temps, il identifie les limites possibles relatives à ce sous-système de l’appareil juridique bolivien. Il souligne tout d’abord que malgré l’apparente incompatibilité de la justice communautaire et du droit positif, l’arrimage de ces derniers est possible. Ensuite, il identifie les principaux obstacles à la pérennité de la légitimité de la reconnaissance du droit autochtone, soit le non-respect potentiel des droits fondamentaux, la corruption et le manque d’éducation et formule des propositions pour confronter ces problèmes. Finalement, l’auteur apporte une piste de réflexion en ce qui concerne la possible applicabilité de cette réforme en partie au Canada en ce qui a trait à ses nations autochtones.
Abstract
This article discusses changes inherent in the establishment of state control by the Bolivian legal system over aboriginal, peasant and community justice. To begin with, the writer points out that this particular type of justice is of customary origin and emphasizes the efforts of the Evo Morales Aima government to officially recognize the existence of aboriginal justice. The writer then identifies the limits implicit in this subset of the Bolivian legal system. He begins by stressing that despite the apparent incompatibility of community justice with positive law, a relationship between them is nonetheless possible. However, the writer identifies the main obstacles to the sustainability of the legitimacy of the recognition of aboriginal law which include the potential for violating human rights, the presence of corruption and a lack of education. He advances certain proposals for confronting these difficulties. Finally, the writer makes specific observations regarding the applicability of certain aspects of this reform to the First Nations of Canada.
