Depuis plusieurs décennies, la communauté internationale lutte contre l’impunité des crimes internationaux commis à l’occasion des conflits armés, des dictatures et autres régimes politiques oppressifs. Traditionnellement, on recourt aux tribunaux nationaux et internationaux. Néanmoins, l’ineffectivité des juridictions pénales nationales, l’inaccessibilité ainsi que la capacité limitée des juridictions internationales font en sorte que seule une infime minorité de victimes reçoive la justice. Compte tenu du caractère massif des atrocités ainsi que du souci de ressouder le tissu social, une recherche de mécanismes alternatifs s’est imposée surtout dans les pays où les crimes ont été commis. Le présent article explore comment l’Afrique a contribué au développement de la justice pénale internationale tant au niveau de sa conceptualisation que de sa mise en oeuvre. Il présente les mécanismes auxquels certains pays africains ont eu recours et dont le principe peut être adopté et adapté aux autres situations similaires. Se fondant sur la participation populaire dans l’administration de la justice, ces mécanismes servent de complément au système judiciaire classique. Leurs potentialités ainsi que leurs faiblesses et défis dans la lutte contre l’impunité des crimes internationaux les plus graves sont largement explorés.
Abstract
For several decades, the international community has been struggling against a form of de facto impunity for international crimes committed during armed conflicts or by dictatorships and other oppressive political regimes. Traditionally, one has had to resort to national and international courts. However, the ineffectiveness of national criminal courts as well as the inaccessibility and the limited capacity of international tribunals enable only a very small minority of victims to obtain justice. Given the massive scale of atrocities and the desire to restore the social fabric, a search for alternative mechanisms becomes essential, especially in countries where the crimes were committed. This article explores how Africa has contributed to the development of international criminal justice, in terms of both its conceptualization and its implementation. It presents the mechanisms to which some African countries have resorted, the essentiality of which could be adopted and adapted to other similar situations. Based on the principle of popular participation in the administration of justice, these processes would be complementary to the traditional justice system. Their strengths as well as their weaknesses and challenges in the fight against impunity for serious international crimes are explored in depth.
