Résumé
La doctrine affirme généralement que l’évolution des normes juridiques en matière de liberté de tester dépend de l’évolution des représentations sociales de la famille et du patrimoine dans une société. Dans cet article, l’auteure étudie comment cette évolution s’est traduite dans la doctrine québécoise.
L’étude rappelle que la liberté illimitée de tester – une liberté « imposée » par les Anglais – a été largement critiquée par la doctrine parce qu’elle faisait fi de la famille du défunt. L’étude montre cependant comment cette même liberté de tester a d’abord été « encensée » par la doctrine – cette fois-ci, à titre de principe du droit civil québécois – parce qu’elle correspondait à une conception personnelle de l’appartenance du patrimoine.
Abstract
It is generally held in legal doctrine that juridical norms relating to testamentary freedom evolve as a reflection of a society’s conceptualization of the family and of the notion of ownership. In this article, the writer examines how this evolution has found its place in Québec doctrine.
The article underlines that the unfettered freedom of disposition by will - a freedom "imposed" through the influence of English law - has been widely criticized in legal literature because of an inherent disregard for the family of the deceased. The writer points out how originally, the principle of freedom of willing was enthusiastically embraced by legal writers because it was viewed as a principle of Quebec civil law in that it reflected an individualistic approach to patrimonial ownership.
