Il est reconnu en droit canadien qu’une disposition imprécise, au point de ne pas tracer une sphère de risque permettant un débat judiciaire, peut être invalidée puisqu’elle contrevient ainsi à la Charte canadienne des droits et libertés. Dans ce contexte, à quelle considération a droit le citoyen dans sa compréhension de dispositions pénales souvent obscures ?
Dans cet article, l’auteure examine la théorie de l’imprécision tel qu’elle est actuellement appliquée par les tribunaux canadiens, dans le contexte des dispositions criminelles et pénales. Par la suite, une analyse critique de cette théorie s’articule en trois axes principaux : la position précaire du citoyen, la situation privilégiée du législateur et la mise en péril de la séparation des pouvoirs. Enfin, l’auteure propose une norme plus respectueuse du citoyen : l’intelligibilité civile.
Abstract
The proposition that a law can be unconstitutional under the Canadian Charter of Rights and Freedoms due to vagueness if it so lacking in precision that it does not provide sufficient guidance for legal debate, is a recognized principle in Canadian law. In this context, to what extent should a certain indulgence be afforded citizens in comprehending criminal law provisions that are often unclear?
In this article, the writer examines the theory of vagueness in relation to criminal and penal laws as it is currently applied by Canadian courts. A critical analysis of this theory is then presented in reference to three aspects of the question: the vulnerability of the citizen, the privileged situation of parlementarians and the imperilment of the separation of powers. The writer concludes by proposing a standard which is more respectful of the citizen: the intelligibility of legislation from a layperson’s point of view.
