Résumé
Les préceptes jurisprudentiels, les préceptes doctrinaux nous enseignent que la lettre de la loi constitue le point de départ de l’interprétation. En effet, tant dans les systèmes anglo-saxons que dans les systèmes civilistes, il fut affirmé avec certitude que lorsqu’un texte est clair, il ne doit pas être interprété. Il arrive néanmoins que les tribunaux, qui sont les principaux interprètes de la loi, soient appelés à l’adapter à l’évolution de la société, à en combler les lacunes, voire même à la rectifier, pour lui donner application. Mais ceux-ci ont toujours été très hésitants à intervenir dans l’oeuvre du législateur. Avec la méthode moderne d’interprétation, ce pouvoir d’intervention du juge dans l’oeuvre du législateur a connu un développement significatif. Notamment, l’intervention particulière du juge en matière constitutionnelle, par la mesure corrective qu’il est possible d’apporter en vertu de l’article 52 de la Loi constitutionnelle de 1982 à la violation de la Charte canadienne des droits et libertés, redéfinit le rôle des tribunaux en donnant un très large pouvoir d’appréciation au juge.
Abstract
According to doctrine and jurisprudence, statutory interpretation begins with the letter of the law. Both the common and the civil law traditions acknowledge that if the words of a statute are clear, then it should be applied as drafted. However, when applying a law, the courts may be called upon to adapt a it to contemporary social reality, to make up for lacunae in a statute and even to rectify it. Although the courts have traditionally hesitated to encroach upon the role of legislators, the modern method of interpretation has led to greater involvement by the judiciary in such matters. A notable example of this phenomenon is encountered in constitutional law where the courts, in determining an appropriate remedy under section 52 of the Constitution Act, 1982, have actually redefined their role by extending the scope of their interpretive powers.
