Résumé
Cet article propose une revue des méthodes, des directives et des sources d’interprétation propres au droit civil québécois. En effet, le droit civil se distingue par l’utilisation particulière qu’il fait, à partir d’une même banque, des différentes méthodes et directives d’interprétation déjà connues. Ces distinctions tiennent tant à la nature du droit civil qu’à la facture d’une codification, et peuvent être soit fondamentales, soit méthodologiques. Dans l’interprétation du nouveau Code civil du Québec, il ne faut donc pas les ignorer.
Abstract
This article reviews the methods, rules and sources of interpretation relating to Quebec Civil Law. While the Civil Law utilizes many generally accepted interpretive methods and directives, it does so idiosyncratically. These distinctive applications, both methodological and fundamental, derive not only from the nature of the Civil Law itself but also from the process of codification. The writer insists that one should not lose sight of this fact when interpreting the new Civil Code.
