Résumé
Les auteurs proposent une analyse de la portée de l’article 1490 du Code civil du Québec, une disposition nouvelle traitant des droits et obligations des parties lorsque la gestion des affaires d’autrui a été entreprise inopportunément. La première partie du commentaire souligne la distinction entre les notions d’opportunité et d’utilité dans le cadre de la gestion d’affaires, tandis que la deuxième partie examine les conséquences juridiques d’une gestion inutile et celles d’une gestion inopportunément entreprise.
Abstract
The writers seek to analyze article 1490 of the Civil Code of Québec, an innovative provision which deals with the rights and obligations of the parties when the management of the business of another has been inopportunely undertaken. The first part sets out the distinction between the notions of opportuneness and of usefulness as they relate to the management of the business of another, whereas the second part examines the legal consequences of a management which has not been useful for the principal or which was not opportune when it was undertaken.
