Résumé
En droit administratif canadien, des décisions récentes ont introduit la notion d’« attentes légitimes ». Dans sa formulation la plus largement acceptée, cette théorie prescrit que la justice naturelle ou l’équité procédurale s’impose à l’autorité administrative non seulement lorsqu’elle rend une décision qui affecte des droits, privilèges ou intérêts individuels, mais encore chaque fois qu’un tel acte porte atteinte aux « espérances légitimes » d’un particulier. L’auteure propose une étude des principales composantes de cette théorie. Elle souligne trois éléments qui permettent d’en évaluer l’impact sur l’état actuel du droit et formule quelques observations sur l’évolution qu’elle risque de subir dans les prochaines années.
Abstract
Recent administrative law decisions introduce the "legitimate expectation" concept. Generally speaking, this concept prescribes that an administrative authority has to respect natural justice or the duty to act fairly, not only when its decisions affects individual rights, interests or privileges, but also when one of its decisions affects an individual's "legitimate expectation". The author presents a study of the major components of that theory. She brings in three elements by which the impact of that concept on the present state of the law can be evaluated and adds some observations about its possible evolution in the next few years.
