Résumé
La réforme du Code civil est marquée au triple coin de l’unité, de la continuité et de la nouveauté de l’oeuvre législative. C’est de ces trois points de vue que, s’appuyant notamment sur la Disposition préliminaire du Code civil, les dispositions générales de droit transitoire de la Loi sur l’application de la réforme du Code civil, les modifications apportées à la Loi d’interprétation et les traditions civilistes d’interprétation, l’auteur propose un certain nombre de repères, non seulement pour l’interprétation du Code civil, mais pour l’ensemble de la législation civile. Il plaide en conclusion pour une conception civiliste de l’autorité du précédent, mêlée de respect et de sens critique, subordonnée au droit commun législatif et aux droits de la raison.
Abstract
Unity, continuity and a search for novel solutions are the hallmarks of the recent reform of the Civil Code. From this triple perspective and basing himself on the Preliminary Provision of the Civil Code, the general transitional provisions of the "Act Respecting the Implementation of the Civil Code", the amendments to the "Interpretation Act" and the civilian tradition of interpretation, the author suggests a principled approach to interpretation, not only of the new code, but of all legislation dealing with civil law. He concludes with a plea in favour of a civilian conception of the authority of precedent, incorporating both respect and critical judgment, which subordinates judicial authority to that of the "jus commune" expressed in the written law and to the dictates of reason.
