Résumé
Dans cette étude sur les problèmes de preuve en droit des assurances, l’auteur dégage d’abord les règles applicables : les règles habituelles de preuve ont généralement leur effet, mais les besoins spéciaux du domaine des assurances ont nécessité des exceptions. Puis l’auteur examine les situations les plus névralgiques où se rencontrent les problèmes de preuve. Pour chacune d’elles, il s’intéresse aux éléments à prouver et à la répartition du fardeau de la preuve entre les parties. Ce texte présente un intérêt spécial pour les praticiens du droit quotidiennement confrontés à cette problématique de la preuve.
Abstract
In this study relating to the problems of proof in matters of insurance, the writer begins by setting out the pertinent rules. While the ordinary rules of proof generally suffice, special needs encountered in the area of insurance litigation have necessitated the development of a certain number of exceptions. The writer then examines those situations where problems of proof are most acute. In each situation, he describes the substance of what needs to be proven and he examines issues concerning the attribution of the burden of proof between the litigants. This paper will be of particular interest to those in the legal profession who are often confronted by evidentiary problems of this nature.
