Abstract
The definition of insurable interest has been recently modified by the Supreme Court of Canada. Indeed, in the case of Constitution Insurance Co. of Canada c. Kosmopoulos, the Court has drastically and deeply reviewed and reformed this rule. This article is aimed at establishing the correctness of this decision. To this end, the author examines the policy and the history of this principle. This will allow the reader to better understand and appreciate the importance of this evolution in the area of insurance.
Résumé
La définition d’intérêt d’assurance a récemment fait l’objet d’une réforme jurisprudentielle majeure. En effet, dans l’arrêt Constitution Insurance Co. of Canada c. Kosmopoulos, la Cours Suprême a revisé cette notion en profondeur. Le présent article vise à démontrer la justesse de la décision rendue par le Cour suprême. A cette fin, l’auteur étudie tour à tour le fondement social puis l’évolution historique de cette règle. Aux termes de cette étude, le lecteur sera en mesure de mieux saisir et apprécier l’importance de ce changement radical dans le domaine du Droit des assurances.
