Résumé
La protection de la personne humaine impose le respect de sa volonté libre et éclairée lorsqu’il s’agit d’accomplir des actes portant sur son corps. Cependant, l’abstraction du principe fait conduire à des conséquences néfastes pour l’intéressé. Une protection efficace de ce dernier peut exiger parfois qu’il soit passé outre un refus de soins. A quelle conditions et à l’aide de quelles procédures ?
Abstract
Before any art may be performed on an individual, the very notion of protection of the human person implies that prior free and enlightened consent be obtained. However, observance of this principle in an absolute manner could lead to harmful consequences for the person concerned. Indeed, under certain circumstances, the concept of protection of the individual could, according to the author, justify disregarding a refusal of treatment. This article explores the conditions under which necessary treatment could be imposed.
