Idéal champêtre ou enfer ouvrier ? Démystifier la terre pour renforcer les droits des travailleurs agricoles

Résumé

Cet article vise à exposer la persistance d’un discours romantique associé à l’agriculture et l’impact de cette image idéalisée de la terre sur la protection des travailleurs agricoles. Le portrait romantique de l’agriculture présente ce secteur économique comme étant fragile, capricieux, essentiel à la survivance humaine et intimement lié à la fois à la vie familiale et à la souveraineté nationale. Nous verrons que le mythe agricole est favorisé par la répétition d’un certain discours d’exceptionnalisme adopté tout au long de l’histoire occidentale dans la théorie et la pratique juridique et économique ainsi que dans la culture populaire et qu’il met l’accent sur la primauté de la propriété privée et la nécessité de protéger l’agriculture contre toute ingérence. Ce mythe cache toutefois la réalité des salariés agricoles tout en justifiant un traitement dérogatoire aux lois du travail. L’analyse du contexte législatif canadien contemporain en matière de protection des salariés agricoles démontrera la persistance du discours romantique en agriculture, véhiculé par de puissants lobbys agricoles et repris par les instances politiques, et son impact négatif sur les droits fondamentaux des travailleurs de la terre.

Abstract

This article aims to showcase the persistence of romantic discourse associated with agriculture and the impact of the idealized image of the land on the protection of agricultural workers. The romantic portrayal of agriculture presents this economic sector as fragile, capricious, essential to human survival, and intimately linked to both family life and national sovereignty. We will see that the agricultural myth is favoured by the repetition of a certain discourse of exceptionalism adopted throughout Western history in legal and economic theory and practice as well as in popular culture and that it emphasizes the primacy of private property and the need to protect agriculture from interference. This myth, however, hides the reality of agricultural workers while justifying derogatory treatment of labour laws. The analysis of the contemporary Canadian legislative context in terms of the protection of agricultural workers will demonstrate the persistence of the romantic discourse in agriculture, conveyed by powerful agricultural lobbies and taken up by political authorities, and its negative impact on fundamental rights of workers of the land.
