Résumé
Cette étude s’intéresse à l’influence que peut avoir la présence de comportements paraphiliques sur le processus criminel des violeurs et sur le modus operandi qu’ils utilisent pour mener à bien leur acte. L’objectif de cette recherche est de tester plusieurs dimensions des comportements paraphiliques telles que leur présence ou non, leur nombre, ainsi que leur type. Cette recherche se base sur un échantillon de 3253 cas de viols commis en France, dont 2513 ont été commis par des individus sans comportements paraphiliques tandis que 740 concernent des agresseurs chez lesquels au moins une déviance sexuelle était présente. L’échantillon a été limité aux victimes âgées de plus de 16 ans qui ne connaissaient pas leur agresseur au moment des faits. La méthodologie utilisée suit une approche quantitative avec des analyses bivariées et multivariées. Trois différents modèles de régressions (binomiale, binomiale négative et multinomiale) ont été établis afin de tester les différents aspects entourant la notion de paraphilie. Les résultats indiquent systématiquement des différences entre le mode opératoire utilisé par les agresseurs ayant des troubles paraphiliques et les autres, quelle que soit la dimension testée. Cette étude présente des implications aussi bien théoriques que pratiques, concernant la compréhension du processus de décisions des agresseurs sexuels, de profilage criminel et de l’investigation policière.

Abstract
This study examines the effect of paraphilic behaviors on the criminal process and modus operandi of rapists. We consider several dimensions of paraphilic behaviors, such as whether or not they were present, how often they were found, and the type of such behaviors if present. The research is based on a sample of 3,253 cases of rape committed in France, 2,513 of which were committed by individuals without paraphilic behaviors, while 740 involved perpetrators who presented at least one paraphilic behavior. The sample was restricted to those whose victims were aged 16 years or above and who did not know the perpetrator at the time of the offense. A combination of bivariate and multivariate analyses were used to examine the data. Three different models of regression (binomial, negative binomial, and multinomial) were used to test the different dimensions related to paraphilic behavior. Findings indicate strong differences between the modus operandi used by paraphilic and non-paraphilic offenders. We discuss the theoretical and practical implications of these findings in relation to the decision-making process of sex offenders, offender profiling, and criminal investigation.

Este estudio se interesa por la influencia que puede tener la presencia de comportamientos parafílicos sobre el proceso criminal de los violadores y sobre el modus operandi que utilizan para cometer su acto. El objetivo de esta investigación es hacer una prueba de varias dimensiones de los comportamientos parafílicos, así como su presencia o ausencia, su cantidad, y su tipo. Esta investigación se basa en una muestra de 3253 casos de violaciones cometidos en Francia, de los cuales 2513 fueron cometidos por individuos sin comportamientos parafílicos, mientras que 740 conciernen agresores que tenían por lo menos una desviación sexual. La muestra se limitó a las víctimas de más de 16 años, quienes no conocían a su agresor en el momento de los hechos. La metodología utilizada tiene una aproximación cuantitativa con análisis bivariados y multivariados. Tres modelos diferentes de regresión (binomial, binomial negativo y multinomial) fueron establecidos para probar los diferentes aspectos alrededor de la noción de parafilia. Sistemáticamente, los resultados indican la existencia de diferencias en el modus operandi utilizado por los agresores con trastornos parafílicos y los demás, sin importar la dimensión probada. Este estudio presenta implicaciones teóricas y prácticas respecto a la comprensión del proceso de decisiones de los agresores sexuales, de perfilado criminal y de investigación criminal.
