Résumé
Le mouvement de mondialisation rapproche de plus en plus le droit civil et la common law. Plus la norme internationale se développe, plus il existe une cohabitation obligatoire dont le défi est d’être cohérent et effectif. Le Code civil du Québec est un exemple d’une codification subissant l’influence du contexte international tant par son style de rédaction que par ses références au droit comparé. Il témoigne aussi fort bien du fait que la cohabitation des deux systèmes juridiques les plus importants au monde, common law et droit civil, est non seulement possible, mais aussi très enrichissante pour la règle de droit.
Abstract
The globalization movement is drawing the civil law and common law systems ever closer together. The more international standards develop, the more these systems share common grounds where the challenge is one of remaining coherent and effective. The Civil Code of Quebec provides an example of codification undergoing the influence of international trends both in its style of drafting and by its references to comparative law. It also clearly bears witness to the fact that such sharing of common grounds among two of the world’s most important legal systems is not only possible, but also most enriching for the rule of law.
