Les implications constitutionnelles, pour le Canada, d'un éventuel partenariat avec un Québec souverain

Abordant sous l'angle de la technique juridique l'enjeu du partenariat Québec-Canada, l'auteur s'intéresse à ses implications constitutionnelles pour le Canada. Après avoir esquissé un modèle pour les rapports Québec-Canada dont les principaux rouages s'inspirent de l'Entente du 12 juin 1995 et de la Communauté européenne, il fait valoir que le déploiement du partenariat dans le droit interne canadien pourrait emprunter des éléments à l'expérience du Royaume-Uni en ce qui a trait à l'arrimage de son ordre juridique interne avec le droit européen. Il soutient d'ailleurs dans son étude qu'un tel déploiement pourrait se réaliser au moyen d'un instrument législatif semblable à la principale loi britannique de mise en oeuvre des traités européens, l’European Communities Act 1972. Dans la dernière partie, l'auteur propose une analyse de certaines problématiques constitutionnelles qui se dessinent avec le modèle du partenariat avancé : elles concernent les transferts de souveraineté, la production d'instruments normatifs supranationaux, le système juridictionnel du partenariat, la suprématie parlementaire, l'organisation fédérale du Canada de même que la réception dans l'ordre juridique interne du Canada d'un principe qui poserait la primauté du droit du partenariat sur le droit national.

Abstract

In approaching the issue of a Québec-Canada partnership from the angle of legal technicalities, the author seeks to examine their constitutional implications for Canada. After drawing up a model for Québec-Canada relations, the main workings of which are inspired from the June 12th 1995 Agreement and the European Community, he emphasizes that the integration of the Partnership into Canadian national law could take inspiration from the United Kingdom's experience with regard to the articulation of its internal legal functions with those found in European law. This study further maintains such an integration could come about by legal provisions similar to the main British statute used in implementing European treaties, namely the European Communities Act 1972. The last part proposes an analysis of various Constitutional issues that would come with the suggested Partnership. They would involve transfers of sovereignty, the drafting of supranational normative instruments, the Partnership's jurisdictional system, Parliamentary supremacy, the federal organization of Canada as well as the integrating into Canada's national legal system of a principle that would state the primacy of Partnership law over national law.
