La loi dans le droit : tradition, critique et transformation

Résumé

L'évolution des pratiques législatives au cours des dernières décennies justifie une réflexion sur le rôle actuel de la loi dans le système juridique, et sur les transformations de ce rôle par rapport au passé et dans l'avenir. Cette réflexion prend appui sur un rappel historique des fondements du concept de loi dans les systèmes de droit romano-germaniques et anglo-saxons. Ce retour sur la notion de loi montre qu'elle est en étroite liaison avec la philosophie rationaliste et le phénomène révolutionnaire. Différents courants de la pensée juridique contemporaine fournissent par ailleurs des perspectives analytiques et critiques sur la place actuelle et la transformation du droit légiféré. La conception positiviste dominante est notamment confrontée à la critique marxiste et radicale, à la critique néolibérale et à la critique féministe. Ces différentes intuitions critiques peuvent éclairer le devenir de la loi dans le droit québécois. Deux cheminements sont envisageables, l'un impliquant le « décentrage » du droit, le déplacement de son centre de la loi vers un nombre limité de principes et notions flous, l'autre supposant un « recentrage » du droit sur la loi, celle-ci voyant son champ matériel refluer mais sa charge symbolique être réactivée, notamment par un renforcement de la participation civique à son élaboration.

Abstract

In the light of changing practices and attitudes as regards legislation over the last few decades, fresh thinking is needed on the role of legislation in the legal system, on the extent to which a break has been made with the past, as well as on prospective developments. The starting point is a review of the historical foundations of the concept of legislation in both roman-germanic and anglo-saxon legal systems. This brings out the close connection between legislation, the philosophy of reason and revolutionary change in the political order. Various approaches in contemporary thinking on the law provide analytical or critical insights into the current position of legislation in Western legal systems and the way in which such position is being transformed. Mainstream thinking from the positivistic stand-point is challenged by—inter alia—marxism and radical criticism, neo-liberalism, and feminism. Perspectives opened up by those various critical approaches may shed light on the future position and character of legislation within the legal system of Quebec. Two paths of development may be envisioned. One involves shifting the centre of the legal system away from legislation towards a limited set of fluid principles and concepts. The other implies re-emphasizing legislation as the centre of the system, while rolling back the legislative tide and reactivating the symbolic meaning of legislation—especially through the development of new forms of civic involvement in the legislative process.
