Résumé
Cet essai se penche sur la normalisation de la perception dans la modernité en prenant pour axe la construction matérielle et juridique de l’environnement bâti. Il commence par une analyse de l’ambiance sensorielle du gratte-ciel et du bungalow et de leur impact sur la formation des subjectivités de ceux qui y habitent. Il examine ensuite le problème de la sensation excessive — à savoir les bruits et les odeurs indésirables et les autres effluves qui sont l’inévitable sous-produit de la vie en société dans des concentrations de population toujours plus importantes. Quelles sont les limites du tolérable ? Comment la loi intervient-elle dans la gestion du sensible ? Nous explorons ces questions en faisant référence en particulier à la notion d’« obligations de voisinage » dans le droit civil québécois. Nous concluons que tout compte rendu de la perception de l’environnement doit être au diapason de la normalisation de l’expérience des sens au sein d’un régime sensoriel particulier — ou de l’indissociabilité du social, du matériel et du sensible.

Abstract
This essay is a study in the normalization of perception in modernity centring on the material and juridical construction of the built environment. It begins with an analysis of the sensory ambiance of the skyscraper and the bungalow and their impact on the formation of the subjectivities of those who dwell within them. It goes on to consider the problem of excessive sensation—that is, the unwanted sounds and smells and other effluvia which are an inevitable by-product of living together in society in ever-greater concentrations. What are the limits of toleration? How does the law intervene in the management of the sensible? These questions are explored with particular reference to the notion of the “obligations of neighbourliness” in the civil law jurisdiction of Quebec. It is concluded that any account of the perception of the environment must be attuned to the normalization of sense experience within a particular sensory regime—or, the indissociability of the social, the material and the sensible.

Resumen
Este ensayo examina la normalización de la percepción en la modernidad teniendo como eje la construcción material y jurídica del entorno edificado. Se inicia con un análisis del ambiente sensorial del rasca-cielos y del bungalow y de su impacto en la construcción de las subjetividades de quienes ahí habitan. En seguida examina el problema de la sensación excesiva —a saber, los ruidos y los olores indeseables y los otros efluvios que son el inevitable subproducto de la vida en sociedad en concentraciones de población cada vez más importantes. ¿Cuáles son los límites de los tolerable? ¿Cómo interviene la ley en la gestión de lo sensible? Exploramos estas cuestiones refiriéndonos en particular a la noción de «obligaciones de buena vecindad» en el derecho civil quebequense. Concluimos con que toda descripción de la percepción del medio ambiente debe estar en diapasón con la normalización de la experiencia de los sentido en el seno de un régimen sensorial particular —o de la indivisibilidad de lo social, lo material y lo sensible.
