Résumé
L’article propose un survol du cadre normatif régissant la protection de la confidentialité de l’information à caractère personnel (dont l’information génétique) échangée à l’occasion de la souscription d’un contrat d’assurance. L’opération assurantielle implique impérativement un échange de renseignements, de données. Cet article vise à répertorier et à examiner les principales dispositions législatives et réglementaires concernant l’encadrement de l’échange d’information personnelle, et ce à l’ère de la mise en réseau, de l’informatisation. Il s’attarde tout d’abord sur le cadre normatif en vigueur au Québec pour ensuite examiner les règles applicables en France. Dans chacun des cas il traite, dans un premier temps, des règles générales destinées à assurer la protection de la vie privée pour ensuite examiner, de façon plus spécifique, les règles propres au domaine de l’assurance.

Abstract
This article is an overview of the legal framework governing the protection of the confidentiality of personal information (genetics) exchanged during an insurance contract subscription. The exchange of data and information is imperative to all insurance operations. The aim of this article is to catalogue and then examine all of the most relevant legislative provisions with respect to the framing of exchange of personal information. This is done with a specific perspective on the rising era of networking and computerization. It begins by broaching the legal framework in practice in Quebec then follows with the examination of existing rules in France. In each case, we pass from general rules intended to ensure the protection of privacy to the specific rules governing privacy in insurance.
